- 【1】권리변동 (權利變動)
권리의 발생•변경•소멸을 말한다. 권리의 변동을 주체 입장에서 보면 권리의 취득•변경•상실이 된다. 이러한 권리변동을 일으키는 모든 원인을 법률요건이라 한다.
【2】법률관계 (法律關係)
인간의 사회생활은 법•관습•도덕•종교 등 다양한 사회규범에 의해 규율되는 데, 이 중 법에 의해 규율되는 생활관계를 말한다. 그 생활관계에 있어서 당사자가 꾀하는 효과가 법의 힘에 의하여 보장되고 실현된다는 점에서 단순히 도덕이나 또는 종교 등의 힘으로만 보장되는 생활관계와 구별된다.
【3】취득(取 得)시효(時效)
물건 또는 권리를 전유하는 사실상태가 일정 기간 동안 계속되는 경우에, 그것이 진실한 권리관계와 일치하는가의 여부를 묻지 않고, 권리취득의 효과가 생기게 하는 시효제도를 말한다. 소멸시효와 대립되는 개념이다.
【4】선의(善 意)취득(取得)
거래의 안전을 위하여 동산의 점유에 공신력을 인정하는 제도를 말하며, 즉시취득이라고도 한다. 민법은 부동산의 등기에는 공신력을 인정하지 않으면서 동산의 점유에는 공신력을 인정하고 있다.
【5】무주물선점 (無主物先占)
주인 없는 동산을 소유의 의사로 먼저 점유한 자가 소유권을 취득하는 것을 말한다. 선점의 객체는 동산인 무주물에 한하며, 무주의 부동산은 국유가 되므로 선점의 목적이 되지 않는다.
