- Une hypothèque est un droit accordé à un créancier (par exemple une banque) sur un bien immobilier (ou exceptionnellement sur un bien meuble assimilable à un immeuble tel un navire) en garantie d'une dette, sans que le propriétaire du bien qui constitue la garantie en soit dépossédé.
Un bien hypothéqué est un bien qu'un créancier peut faire saisir si le débiteur ne remplit pas l'obligation principale (par exemple les échéances ne sont pas payées), afin de le mettre en vente, et d'être remboursé par préférence sur le prix de vente.
Une hypothèque est prise par le biais d'un notaire dans les juridictions de droit civil. Elle est aussi ouverte aux avocats dans celles de droit anglo-saxon s'il n'est pas prévu un organisme géré par la puissance publique de conveyance, ou dans certains cas d'un juge. Elle fait l'objet d'un enregistrement sur un registre officiel.
