If possible I think you should check with your client. ; don't you think there is a word missing?
Isn't it rather "neither party shall be liable for any **loss of** prospective ///profits///, exemplary or special damages, ...".
This would be far more logical in view of the whole sentence...
This would mean that none of the party is liable for any loss/damage arising from the implementation of the agreement and in partic. from use of the goods provided.
This is a usual clause in contracts relating to the provision of goods/services.

on pourrait traduire par "bénéfices" toutefois dans le contexte le terme de "profit" est plus ouvert et offrira une couverture plus large dans le cadre du contrat laissant la porte ouverte aux profits financiers et aux profits matériels de quel qu'ordre qu'ils soient

il faut tenir compte de profits qui pourraient être litigieux, frauduleuses ou malhonnêtes. D'autre part il pourrait y avoir ventes, mais qu'elles ne soient pas payées par le destinataire, Dans ce type de contrat il faut envisager toutes les situations.
