B. nicht auf die Richtlinie 96/71 zutrifft, die auf den Vertragsbestimmungen über den freien Dienstleistungsverkehr beruht und bezweckt, die kollisionsrechtlichen Vorschriften der Mitgliedstaaten, nach denen sich das auf eine grenzüberschreitende Dienstleistung im Fall einer vorübergehenden Entsendung von Arbeitnehmern innerhalb der Gemeinschaft anwendbare innerstaatliche Recht bestimmt, zu koordinieren, ohne das Sachrecht der Mitgliedstaaten auf dem Gebiet des Arbeitsrechts und der Arbeits- und Beschäftigungsbedingungen – hinsichtlich insbesondere der Lohnhöhe – oder das Recht, kollektive Maßnahmen durchzuführen, zu harmonisieren.

It may be appropriate to point out that Directive 96/71, for example, does not fall within that case, being based on the Treaty provisions governing the freedom to provide services, and the purpose of which is to coordinate the conflict-of-laws rules of the Member States in order to determine which national law should apply to the provision of cross-border services where workers are posted temporarily abroad within the Community, without harmonising either the substantive rules of the Member States as regards employment law and the terms and conditions of employment relating, in particular, to rates of pay, or the right to resort to collective action.

Vorsorglich möchte ich hinzufügen, dass entgegen dem Vorbringen etlicher Beteiligter vor dem Gerichtshof, wie etwa Laval, eine derartige Beurteilung keinen Eingriff in die negative Vereinigungsfreiheit des Dienstleistenden oder der von ihm entsandten Arbeitnehmer darstellt, nämlich in das Recht, keiner Gewerkschaft beizutreten oder aus einer solchen auszutreten(100), dessen Beachtung der Gerichtshof meiner Meinung nach sicherzustellen hat.

For the sake of completeness, I would add that, contrary to the contentions of certain parties involved in the proceedings before the Court, including Laval, there is no implication in that assessment of any impairment of the negative aspect of the freedom of association of the service provider or of the workers posted by it, namely the right not to join, or to withdraw from, a union, (100) the observance of which, the Court must in my opinion ensure.
