la sortie du programme

broadcast = le programme (ici, le film publicitaire vantant les mérites du "reserved device")
release = la sortie
D'après le contexte, ça n'aurait aucun sens de demander l'approbation de la FDA au moment où le programme est diffusé. Par définition, ça, ce serait trop tard ....

My reading is that the ad material is submitted to the FDA at the same time as it is sent to the broadcast media for inclusion in future ad-breaks. The first airing may come some time later (maybe several days later).

That is consistent with the functions of the FDA which, AFAIK, cannot censor ads in advance but does need to be informed in a timely manner about upcoming ads for certain products so it can respond to eventual complaints from viewers.

Note that 'diffusion' occurs many times whereas submission to the FDA occurs only once (for a given ad), so 'diffusion' is not appropriate here.

Limited authority of FDA over DTC advertising

Drug companies must submit advertisements for FDA review only at the time of airing; the FDA has no power to force companies to preclear advertising, although some choose to do so. If the agency deems that an advertisement does not comply with regulations, it sends warning letters proposing changes to the ad. However, because the FDA guidelines are not full-blown regulations, the agency does not have the power to fine or otherwise sanction drug companies for running misleading ads.
