neutral Jessica Noyes : I think your answer is correct from an accounting standpoint, as the value of goodwill is entered as an intangible, sometimes further broken down to "fondo de comercio." However, the example seems to be dealing with goodwill in a more general way.

En este caso "goodwill" se refiere al valor adicional que la empresa ha generado para sí como resultado de su buen nombre, es decir, un intangible y no algo que se mida por los activos que posea.

Entiendo que estás traduciendo sobre un problema de uso de marca, imágenes, logos o algo por el estilo. La acusación es que fulanito se aprovecha (fíjate en lo de "free riding") de la similitud visual o de otro tipo que hay entre su producto y otro producto que está mucho más establecido en el mercado.
