Stand by for the usual facetious and facile comment of 'another case of lawyers/notaries using two words when one will do.'

There are few true synonyms in (Mexican/Spanish) lawcf. Tom West III's ES>AmE law dictionary: defecto de fondo = substantive defect; syn) vicio de fondo.

*Flawed* = defective consent indeed, whilst the latter overlaps with defect in th second part.

As Adrian says, it's difficult to find a suitable equivalent for "vicio", which often implies "vicio del consentimiento" (error, fraud, duress), and "vitiation" doesn't feel like a good solution, but you could phrase it another way:

...to enter into this agreement, which is not vitiated or impaired by anything that might invalidate it.
