Spanish term

figura que ha quedado desligada

Spanish to English Law/Patents Law: Contract(s)
From a claim for unpaid invoices due to a Spanish law firm for arbitration services.

"A continuación demostraremos que la relación que obliga a las partes es un contrato de arrendamiento de servicios, figura que ha quedado desligada, según nuestra mejor doctrina, de la del mandato."

I don't understand the meaning of the final part, "figura que ha quedado desligada... de la del mandato"

Discussion

Charles Davis Dec 24, 2017:
They are arguing here that payment is due because the agreement between the parties is not an agency agreement but a service agreement, and that these are different legal concepts. In a service agreement, professional services are provided for consideration. In an agency agreement, there may or may not be consideration:

"A falta de pacto en contrario, el mandato se supone gratuito.
Esto, no obstante, si el mandatario tiene por ocupación el desempeño de servicios de la especie a que se refiera el mandato, se presume la obligación de retribuirlo."
Spain, Civil Code, Art. 1711.

Spanish term (edited): figura que ha quedado desligada... de la del mandato
Selected

a concept ... characterised as distinct from that of the agency agreement

Bit of a mouthful, but I believe that's the idea being expressed here.

Neil's idea is almost right (i.e., it works by extension), but "figura" doesn't exactly mean "the thing they've just mentioned", it refers to a legal "concept" or "notion".
The argument may be that these two concepts have been blurred in the juristic act in question, perhaps rendering it invalid in this jurisdiction.

So:
"...a concept our best legal minds have characterised as distinct from that of the agency agreement"

agree Charles Davis : That's it. See here: https://www.iberley.es/practicos/caso-practico-diferencias-e... . Distinguished in Civil Code (Arts 1544 and 1709 onwards respectively).

Many thanks for providing a reference to support my guesswork, Charles. A belated happy new year!

... which has no bearing on..

"Figura" just means the thing they just mentioned, which they consider no longer applies/does not apply to "la del mandato".
