The upshot of it is, if only one spouse petitions for divorce, the divorce petition must be accompanied by a well-founded (or reasonable) proposal (or offer) of provisional measures that will determine the division of marital assets and other contested issues (child support, child custody, alimony, etc.) I think of this more as a suggestion for how things should be divided rather than an offer of compensation (ancillary relief), but that might be splitting hairs.

After the spouse who petitioned for divorce provides that proposal, the other spouse either agrees or appeals that by making a counter-offer (these probably aren't the proper terms, but you get the idea.)

I researched this one quite a lot, but I won't submit an Answer because I can't come up with anything significantly different from the two answers already submitted.

The country in question was not mentioned, but I guessed it was Spain as the Asker is in Spain and this turned out to be right. I searched for explanations of contested and uncontested divorce in Spain, in both Spanish and English.

Here are a few relevant passages:

I think that "la propuesta fundada de medidas" is an established legal expression in Spain for which there is not a direct equivalent in English. It contains implicit information (such as what these measures or "medidas" are regarding). I think that it needs to be spelled out in the translation, even if it's a little cumbersome. For example: "a substantially justified motion to determine arrangements for child custody, division of assets, and alimony." I think the indeterminate article "a" should be used rather than "the" because in English this is not an established legal term. The English translation will be an unpacking of its meaning rather than some handy well-known equivalent. In Spain "la propuesta fundada de medidas" is to a contested divorce as the "convenio regulador" (governing convention, or what we would call a divorce settlement agreement) is to an uncontested divorce. In English such a proposal or request regarding how everything gets divvied up is just considered part of the divorce petition itself, rather than an add-on.

I chose the word "motion" because it is the translation of "propuesta" that best suits the situation: "A motion, in its simplest form is a list of requests that you are asking the Court grant on your behalf. You, or your attorney on your behalf, will file a Notice of Motion which includes a list of requests for the court to rule upon."

From that, "substantially justiified motion" is a well-established collocation.

I suggest "arrangements" as a translation of measures. Two phrases that I saw a lot of while researching were "provisional measures" and "arrangements," always shoe-horned together, and it seems a waste of words. According to wordreference.com, some synonyms for "arrangements" include: "plans, preparations, preparatory measures, provisions, accommodations, more..." Well, that's perfect. That's exactly what we're talking about: arrangements.

The item being translated is a divorce by consent decree, but the phrase that needs translating relates to the situation of only one spouse filing for divorce. "Motion" could be changed to "petition." I agree that "ancillary relief" should be in there.

Query if includes arrangements for any children of the union, property - goods and land - division and maintenance payments.

Possibly financial relief would be likelier in AmE or CanE.

Thank, Chris. The problem is that the 'Battle of Largs' asker is UK to which 'ancillary relief' is specific as opposed, say, to a one-size-fits-all 'reasonable arrangements offer'. Again, propuesta is no 'court motion' cf. Scots law action vs. petition.

The substantiated proposal for measures includes the reasons for the request for an action, in the case above, a divorce.
Information is provided from a divorce decree or ordinance by mutual consent.
