W Polsce przyjęty został realny system ksiąg wieczystych, co oznacza, że prowadzone są one dla nieruchomości (a nie dla właściciela). Zgodnie z definicją nieruchomości z art. 46 k.c., chodzi tu zarówno o nieruchomości gruntowe, jak i budynkowe oraz lokalowe. Mogą być one także zakładane dla własnościowego spółdzielczego prawa do lokalu mieszkalnego, spółdzielczego prawa do lokalu użytkowego i prawa do domu jednorodzinnego w spółdzielni mieszkaniowej. Księgi wieczyste prowadzi się odrębnie dla każdej nieruchomości, chyba że przepisy szczególne stanowią inaczej.
