Material damage is the difference between the actual financial situation of the insured person and the financial situation that would exist if the damage to health had not occurred.
In the event of a dispute about the origin of such claims, the insurer shall grant the benefit in advance against the assignment of the disputed claims.
This means that the insured person would be placed as they would be if an injuring party were to be liable to them under German law.
