set up is what is used throughout English-speaking Common Law countries, notably at the US, Canadian and English Bar vs. 'bring forth evidence and defences' e.g. in Ireland, North & South.
Note the marginal difference between excepción and defensa:
'La defensa son las negaciones formuladas por el demandado respecto a los hechos o el derecho invocado y hecho valer por el actor. Y las excepciones son las afirmaciones del demandado en relación con los presupuestos procesales o la fundamentación de la pretensión'
