Last Will and Testament

In the event that any beneficiary under this Will, whether such beneficiary is named directly or indirectly, through representation or otherwise, is disabled, receiving or otherwise eligible to receive Medicaid benefits or is unable to adequately care for their finances, the executor may establish a supplemental needs trust for such beneficiary. The discretion of the executor should be reasonable under the totality of the circumstances. The remainder beneficiaries of this supplemental needs trust Last Will and Testament shall be construed from the terms of the Will as if such beneficiary had predeceased me.
