Contractor's Continuous Delays in Release of Work Fronts


Contractor to note that Article 6.11 clearly states that the Subcontract Mechanical Completion date was to be 26th June 2020, which is the date where all the Subcontract Works (ISBL civil works) should have been completed, and all resources demobilized. However, up to date, more than 8 months after the planned Subcontract Mechanical Completion Date, Contractor has yet to released significant portions of the Subcontract Works, leading to continuous and indefinite prolongation. The following tables show the status of remaining work front:



It has been noticed that the percentage of work front release for this part of activity had dropped significantly during recent weeks, without any explanation from Contractor. Thus, the Subcontractor has been left with extensive, under-utilized resources due to issues related to Contractor, with low production rates and excess additional costs to Subcontractor. The following graph shows the trend of available work front of Paving and Grade Slabs during the period from 18th December 2020 to 19th February 2021:



Subcontractor has completed asphalt pavingType I for all the Outside Fence Peripheral Roads, while remaining available work front of 3.5 Km out of 4.5 Km for Inside Fence Peripheral Roads will be completed within 15 days, provided that Contractor arranges sufficient allocation of bitumen. Balance scope of Inside Fence Peripheral Roads is obstructed by Contractor's other activities, while for the balance scope of Internal Roads, Contractor has yet to revert with plan of work front release for those locations.
