De acordo com o contexto apresentado, a jurisprudência lotérica resulta mais da decisão proferida pel[a] consciência do juiz (interpretação subjetiva, pessoal) do que pela interpretação propriamente dita da lei. O poder do juiz é conhecido em inglês como "judicial discretion".
