Volgens Bolt & Spier lag normaal gesproken het maximale bedrag aan immateriële schadevergoeding bij zeer zwaar (lichamelijk) letsel, bijvoorbeeld blind worden aan beide ogen, op zo’n ruim ƒ100.000,- (prijspeil 1993).

Section 47 of the OAPA 1861 is concerned with assault occasioning Actual Bodily Harm. The assault may or may not include battery in the sense of actual contact with the victim i.e. if someone strikes another with their fist causing injury, this will be an assault causing actual bodily harm, as will striking a horse with a whip causing the rider to fall and injure themselves.
Actual bodily harm simply means some bodily harm.
Section 17 of the OAPA 1861 is concerned with causing grievous bodily harm (Grievous Bodily Harm simply means some serious harm. Wounding is any breaking of the skin).

Actual bodily harm (ABH) is an act of violence that causes an injury.
It covers injuries like cuts and bruises.
You don't have to mean to cause the injury to be guilty. It is enough for the prosecution to prove that you could see what you were doing might end up causing an injury of some sort.

When examining what particular category of offence approximately half of this increase primarily relates to, we find three particular areas; common assault, assault occasioning actual bodily harm and public order – disorderly behaviour. These offences are often regarded as being at the lower/less serious end of the violent crime spectrum and are graded as to the gravity of injury sustained. A layperson’s explanation for these categories is as follows;
• Common assault – minor mark left such as a red impression
• Assault occasioning actual bodily harm – cut, bruise or minor broken bone such as nose
• Public order – disorderly behaviour – nuisance and antisocial behaviour
Indications from other forces are that our rise in recorded violent crime this year is below the national average. Encouragingly, the Force detects approximately one in every two violent crime committed.
