Yes, of course, you are both correct: the facts of the case are that the father(German) works in Austria and pays taxes and social security contributions in Austria but lives in Germany with his disabled daughter. He requested social benefits for his daughter from the authorities in Austria, but these authorities refused as the daughter does not reside in Austria. -the issue is that if the daughter is not entitled to benefits in a German state because of several reasons- she might not be considered as so disabled- she would not qualify for benefits in an Austrian state- that is the issue-hope this helps
