Discussion

Beila Goldberg Jan 7, 2014:

Daryo Jan 7, 2014:
@Beila Goldberg whatever some terms considered in isolation may seem to mean (and is possibly the right meaning in a different context), if you don't look at the whole sentence, you end up contradicting yourself,

In no event … will … Air Software … be liable for any ... damages whatsoever … in connection with … ( this Agreement, the Software or the use or inability to use the Software or ) the furnishing, performance or use of any other matters hereunder ... whether based …

When proposing a translation for furnishing, you said that "AI fournit un service informatique ..."
but to translate "matters" wich is part of "the furnishing, performance or use of any other matters
you switch to the service offered by this company being "objet ou de source de litige"?
Put this two together and this company is not proividing services, but good excuses for litigation.
Even if it was true, I don't think they would advertise that in their Terms and Conditions.

English term (edited): any other matters

toutes autres prestations

"matters" could refer to many different things, but when you analyse this long sentence, you can see that here "matters" is part of a list of different services to clients, so it would be:

In no event … will … Air Software … be liable for any ... damages whatsoever … in connection with … ( this Agreement, the Software or the use or inability to use the Software or ) the furnishing, performance or use of any other matters hereunder ... whether based …

abbreviated from:

In no event (including, without limitation, in the event of negligence)

will [Air Software, its employees, agents or distributors] be liable for any

consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss),

in connection with
or arising out of
or related to

-- this Agreement,
-- the Software
-- or the use or inability to use the Software
-- or
the furnishing, performance or use of any other matters hereunder

whether based upon
- contract,
- tort
- or any other theory including negligence,

even if Air Software has been advised of the possibility of such damages.

My point is that if you don't start by parsing the ST in the right way, you'll get the right nuance only by pure luck. La même méthode reste valable en français …

disagree Daryo : "il s'agit d'objet ou de source de litige" that would be a reasonable assumption, until you do some parsing. What would be the “performance” or the “use” of a bone of contention?

disagree Nadaud (X) : La traduction "toutes autres prestations" proposée par Daryo me paraît exacte.
