Neither the failure of the Society to have made a determination prior to the commencement of such action that the claimant is entitled /// to indemnification or advancement under the circumstances///, nor an actual determination by the Society that the claimant is not entitled to indemnification or advancement, shall be a defense to the action or create a presumption that the claimant is not entitled to indemnification or advancement.

This particular part deals with the severability clause and the right for an employee to bring suit if not paid or reimbursed in whole or in part after having incurred expenses for and on behalf of the company.

I'm looking for the best way to translate this part of the sentence and more specifically "advancement"

Re your note: I think that the context makes it clear that they simply omitted the words "of expenses" here. It is not unusual to leave out words that are taken to be understood, though this is undesirable when drafting a legal document, it happens.

Mon problème est que "advancement" seul est habituellement traduit par "à l'avance" et que d'autres clauses du contrat mentionnent bien "advancement of expanses" je pensais donc qu'il ne s'agissait pas d'avances.

Not as I read it. Damages would be awarded by a tribunal. This seems to be about what the Society failed to do, that failure having caused the claimant to put the case before the tribunal.
