TURNOVER OF NON-PERMITTED RECOVERIES
1. Non-permitted payment
If:
(a) the Subordinated Creditor receives a payment or distribution in respect of any of the Subordinated Debt from the Company or any other source other than as allowed under this Agreement; or
(b) the Subordinated Creditor receives the proceeds of any enforcement of any Security Interest or any guarantee or other assurance against financial loss for any Subordinated Debt,
the Subordinated Creditor must hold the amount received by it (up to a maximum of an amount equal to the Senior Debt) on trust for the Lender and immediately pay that amount (up to that maximum) to the Lender for application against the Senior Debt.
2. Non-permitted discharge
If, for any reason, any of the Subordinated Debt is discharged in any manner other than as permitted under this Agreement, the Subordinated Creditor must immediately pay an amount equal to the amount discharged to the Lender for application against the Senior Debt.

Adóssági szerzödések gyakran megengedik pl. a határidö elötti befizetést, de van olyan, hogy nem engedik meg ezt. Különösen igy lehet, amikor adósságok hierachiájáról van szó és a kölcsönz? a számára fontosabb adósságrész törlesztésének rovására nem engedi meg más adósságrész túlfizetését.
