At the start of the document, details of where and when the hearing has taken place and detailing that it is the public prosecutor against the various accused persons. There is a list of the four accused, under the first three it states- just on its own - after detailing their names, date/place of birth, civil status, etc...

I understand that the "defaillant" relates to the defendant not appearing in court and the "present" obviously means they turned up! But combined with the "libre" I'm not sure how to translate it/understand the sense of libre here, other than free....Any ideas

One is present in the court the other is a defaulter. As for libre maybe it means "liberte surveillee"? which is conditional release or on probation.

: guessing really doesn't work for legal docs. we can all guess at what they mean but it's usually best to know for sure.

I'm sure there is better legalistic term, but I would understand this to mean that the defendants were "in the community", as opposed to being incarcerated prior to their court appearance - which would be why one of them is "défaillant".

I can think of legal words for what "libre" is not - in custody, detained - but not their opposites. "On bail" might work, but we don't know if any bail was ever set. And of course "at large" is what the person "défaillant" is now.

I've always associated "bail" with payment of money, but it appears that is a "bail bond". "On bail" may be it.
"bail - Release from custody of a person accused of crime before trial, or of a person convicted of a crime, pending appeal or sentence ... Bail must be granted unless there is reason to believe that the accused would abscond, commit further offences while on bail, or interfere with the course of justice"

: free on bail is what comes to mind but there is no point in guessing. Asker may have to check with client to verify what they mean, unless there is more context elsewhere in the doc.
