Dem Gremium gehört eine nach seiner Einschätzung angemessene Anzahl unabhängiger Mitglieder an, da mehr als die Hälfte der Aufsichtsratsmitglieder in keiner geschäftlichen oder persönlichen Beziehung zur Gesellschaft, deren Organen, einem kontrollierenden Aktionär oder einem mit diesem verbundenen Unternehmen steht.
Entsprechend einer Einschätzung der Europäischen Kommission wird dabei von der Unabhängigkeit der Arbeitnehmervertreter im Aufsichtsrat ausgegangen.

Part of a company's Corporate Governance Declaration. I have no problem translating the second sentence but I can't understand how "According to a European Commission assessment" fits with "the employee representatives on the Supervisory Board are assumed to be independent." Or does "Einschätzung" have a different meaning here?

I think some people may be misunderstanding "ausgegangen" - I wouldn't say "assumed" or "presumed", I'd say something like "are defined as". More than half of the supervisory board members are defined by the EU as independent, so the board itself is independent. I don't know, but it's possible the German itself is not very clear.

In my opinion, the language "presumed to be independent" is completely in line with the German wording and English usage (possible alternatives "considered/deemed independent"):

"A Director will be presumed to be independent for purposes of membership on the Board of Directors and its Committees if the Director.."

Because I have to get the European Commission in there somehow and can't imply that it went to the trouble of assessing this relatively small company's supervisory board, I think I will go for Michael's "In line with"+"presumed" and ViBe's suggested translation of "recommendation" for Einschaetzung."

My shot is

Am I missing something? It seems obvious to be that the only thing that is being eingeschätzt is the "angemessene Anzahl" - they choose to have however many (independent) members they consider appropriate. It is nothing at all to do with assessing whether or not those members are independent - that is taken as read.

neutral ViBe : I see TWO different Einschätzungen here: (1) Gremium’s (d.h. Aufsichtsrat’s) re. the “Anzahl“ => hence “seine” and (2) EU’s re. the degree of independence of its members. This is what your option seems to be failing to convey.

“Eine (indef. art.) Einschätzung” may imply a certain provision in a certain directive / expert opinion / guideline of the EC. So, I’d go with something like: “As per the European Commission / As recommended but the European Commission / According to the European Commission’s guidelines, the employee representatives on the Supervisory Board are assumed to be independent…”

As we don’t know the exact source of law to which the reference is made, we can get around it by simply saying “As recommended but the European Commission…”
Example sentence:

In Recommendation 2005/162/EC [Annex II, 1.(b)] the European Commission concluded that employee representatives under certain criteria can be identified as being independent…
