I know that "priority" is popular with native translators and is probably the word used most in native land law documents.
I do think though that "rank" might also be an option for those as it is used in the translation of the Insolvenzordnung (InsO), German Insolvency Statute, Sec 174 (3), found in the German Law Archive:
(3) Die Forderungen nachrangiger Gläubiger sind nur anzumelden, soweit das Insolvenzgericht besonders zur Anmeldung dieser Forderungen auffordert. Bei der Anmeldung solcher Forderungen ist auf den Nachrang hinzuweisen und die dem Gläubiger zustehende Rangstelle zu bezeichnen.
(3) Lower-ranking creditors shall file their claims only if specifically requested by the insolvency court to do so. Upon filing such claims their lower-ranking status shall be indicated, and the creditor's lower rank shall be designated.
"Formularbuch Zivil-, Wirtschafts- und Unternehmensrecht" (Beck Publishers, includes expert level translations on German legal documents from these fields, even if actually noticeably non-native in nature at times, done by German lawyers at least, say, 'pretty much at home' in the English language) has

I am just not sure about using "at the next highest priority" in a property law ('land law division', i.e. law of immovables) context, you know. I am not sure whether that would be English.
A land charge (Grundschuld) differs from a Hypothek (~ mortgage) in that the Hypothek is accessory, i.e. depends on the existence of the secured claim.

Dietl has "creation of a charge - Bestellung einer Hypothek". So creating does fit here.

I'm sorry I don't have the English equivalent for this term, but I do have a definition of 'Rangstelle' in German which should help in understanding the sense of the text:
Rangstelle
Alle Grundstücksrechte, die im Grundbuch eingetragen sind, stehen in einem Rangverhältnis zueinander, sind also nicht gleichberechtigt.
Die Gläubiger werden bei der Verwertung des Objektes z.B. in der Zwangsversteigerung nach der Rangstelle im Grundbuch befriedigt.
Ein nachrangiges Recht kommt erst dann zum Zug, wenn das vorgehende voll befriedigt ist. Sind im Grundbuch innerhalb der gleichen Abteilung mehrere Rechte eingetragen, so bestimmt sich die Rangstelle nach der Reihenfolge der Eintragungen.
Sind Rechte in verschiedenen Abteilungen eingetragen, richtet sich das Rangverhältnis nach dem Tag der Eintragung. Sind Rechte am gleichen Tag ins Grundbuch eingetragen, sind diese Rechte ranggleich.
