According to the German that does not spell out allein und ausschließlich, the patentee is the sole - but not necessarily the exclusive - owner. What scenario does that cover? For instance, if he has agreed with the licensee to assign the latter the patent on expiry.

Thank you, that looks really good. The person in question IS the owner of the patent for something he has invented, and giving a license to use it to someone else but keeping some control. Would that mean that "exclusive" fits here or not? (Sorry if I am slow to understand this.) |

Perhaps then you, no doubt carrying professional indemnity insurance, can explain why a US American Attorney-at-Law objected to 'exclusive dealership' for Alleinvertriebsrecht and insisted it was a sole distributorship.
