Fiduciario / Fideicomisario

Spanish to English Law/Patents Law (general) Trust agreement / Mexico
Varo & Hughes, as well as the KOG, both seem to indicate that the terms are interchangable, although the passage below seems clearly to indicate that they refer to two different parties here.

I could really use some solid, well-grounded help here.

In this context, the two terms clearly appear to refer to different parties.

Not sure if it makes sense...... In the context of the section that I posted, and assuming the translations offered by Henry and Monica, and endorsed by Richard, are correct, does it really make sense for the "Beneficiary" to be issuing instructions regarding the exercise of rights associated wih the trust? The next passage goes on to say that: (b) Al momento en que el Fiduciario reciba un aviso por pare del Fideicomisario (dicho aviso, un "Aviso de Distribucion") que certifique que ha ocurridoy subsiste un Caso de Distribucion, los Fideicomitentes en este acto ......

And once again, does it make sense that the "beneficiary" of the trust wold be issuing such a notice??

Thank you, Henry. But (pardon my ignorance) what is the difference. Aren't the "trustee" and the "beneficiary" one and the same within te context of Trusts.

Dado que están con mayúscula, habría que ver cómo se definió cada uno de los términos al principiod el contrato, de modo de mantener la coherencia. ¡Suerte!
