Source text - English This Agreement is entered into as of the XX day of October, 200X, between _____________ (“the Committee”) and _____________ (“the Contractor”).
1. Independent Contractor. Subject to the terms and conditions of this Perjanjian, the Committee hereby engages the Contractor as an independent contractor to perform the services set forth herein, and the Contractor hereby accepts such engagement.
2. Duties, Term, and Compensation. The Contractor’s duties, term of engagement, compensation and provisions for payment thereof shall be as set forth in the budget which is attached as Schedule A, which may be amended in writing from time to time, or supplemented with subsequent estimates for services to be rendered by the Contractor and agreed to by the Committee, and which collectively are hereby incorporated by reference.
3. Expenses. During the term of this Perjanjian, the Contractor shall bill and the Committee shall reimburse her for all reasonable and approved out-of-pocket expenses as set forth in Schedule A which are incurred in connection with the performance of the duties hereunder.
4. Written Reports. The Committee may request that project plans, progress reports and a final results report be provided by Consultant.. A final results report shall be due at the conclusion of the project and shall be submitted to the Committee in a confidential written report at such time. The results report shall be in such form and setting forth such information and data as is reasonably requested by the Committee.
5. Confidentiality. Upon the expiration or earlier termination of this Perjanjian, or whenever requested by the Committee, the Contractor shall immediately deliver to the Committee all such files, records, documents, specifications, information, and other items in her possession or under her control. The Contractor further agrees that she will not disclose her retention as an independent contractor or the terms of this Perjanjian to any person without the prior written consent of the Committee and shall at all times preserve the confidential nature of her relationship to the Committee and of the services hereunder.
6. Conflicts of Interest; The Contractor represents that she is free to enter into this Perjanjian and that this engagement does not violate the terms of any perjanjian antara the Contractor and any third party. During the term of this perjanjian, the Contractor shall devote as much of her productive time, energy and abilities to the performance of her duties hereunder as is necessary to perform the required duties in a timely and productive manner. The Contractor is expressly free to perform services for other parties while performing services for the Committee.

1. Kontraktor Independen. Tunduk pada ketentuan dan syarat Perjanjian ini, Komite dengan ini menunjuk Kontraktor sebagai kontraktor independen untuk melaksanakan layanan yang diuraikan di dalam Perjanjian ini, dan Kontraktor dengan ini menerima penunjukan tersebut.
2. Tugas, Jangka Waktu, dan Imbalan. 3. Pengeluaran. Selama jangka waktu Perjanjian ini, Kontraktor akan menagih dan Komite akan mengganti semua pengeluaran tunai langsung yang wajar dan disetujui sebagaimana diuraikan dalam Jadwal A yang dikeluarkan sehubungan dengan pelaksanaan tugas menurut Perjanjian ini.
4. Laporan Tertulis. Komite dapat meminta agar rencana proyek, laporan perkembangan dan laporan hasil akhir diserahkan oleh Konsultan. Laporan hasil akhir wajib diselesaikan di akhir proyek dan diserahkan kepada Komite dalam bentuk laporan tertulis rahasia pada saat itu. Laporan hasil tersebut harus dalam bentuk serta menjelaskan informasi dan data sebagaimana yang diminta oleh Komite.
5. Kerahasiaan. Dengan berakhirnya atau pengakhiran dini Perjanjian ini, atau kapan saja diminta oleh Komite, Kontraktor wajib segera menyerahkan kepada Komite semua berkas, catatan, dokumen, spesifikasi, informasi, dan hal-hal lain yang ada dalam penguasaan atau kendalinya. Kontraktor selanjutnya setuju bahwa ia tidak akan mengungkapkan retensinya sebagai kontraktor independen atau ketentuan-ketentuan Perjanjian ini kepada siapapun tanpa izin tertulis terlebih dulu dari Komite dan wajib selalu menjaga sifat rahasia hubungannya dengan Komite dan sifat rahasia layanan menurut Perjanjian ini.
6. Benturan Kepentingan; Kontraktor menyatakan bahwa ia bebas untuk mengadakan Perjanjian ini dan bahwa penunjukan ini tidak melanggar ketentuan perjanjian apapun antara Kontraktor dengan pihak ketiga. Selama jangka waktu Perjanjian ini, Kontraktor wajib mencurahkan sebanyak mungkin waktu produktif, energi dan kemampuannya untuk pelaksanaan tugasnya menurut Perjanjian ini sebagaimana yang diperlukan untuk melaksanakan tugas yang diwajibkan secara tepat waktu dan produktif. Kontraktor benar-benar sedang tidak melaksanakan layanan bagi pihak lain ketika melaksanakan layanan bagi Komite.

Dalam Peraturan Direktur Jenderal ini, yang dimaksud dengan:
1. Wilayah Nasional adalah Wilayah Negara dan Wilayah Yurisdiksi beserta ruang udara di atasnya.
2. Survei dan Pemetaan yang selanjutnya disingkat Surta merupakan suatu kegiatan yang meliputi pengumpulan data (posisi, arah, ketinggian dan kedalaman dalam bentuk manual maupun digital yang terekam dalam pita magnetik, film, compact disc, storage devices), perekaman, pencitra.an dan pengolahannya termasuk penelitian mengenai gejala dan keadaan permukaan maupun kerak bumi, keadaan perairan termasuk dasar perairan serta kerak bumi di bawahnya dan keadaan di udara, dimana pencetakannya dapat menghasilkan data strategis bagi kepentingan kesejahteraan masyarakat dan pertahanan negara.
3. Pengamanan Kegiatan adalah setiap usaha dan tindakan yang dilakukan Security Officer untuk mengawasi dan mengamankan serta meneliti segala sesuatu yang berhubungan dengan penyelenggaraan maupun penyelesaian kegiatan, sehingga kegiatan dapat berjalan sesuai tersebut dalam Security Clearance.
4. Wahana adalah alat apung/kapal iaut atau pesawat udara yang digunakan untuk mendukung kegiatan di lokasi, baik berbendera Indonesia maupun asing.
5. Lokasi Survei adalah bagian wilayah tertentu dari seluruh Wilayah Nasional.
6. Alat Peralatan adalah seluruh instrumen kegiatan yang digunakan personel secara langsung melakukan kegiatan di lokasi, baik terpisah maupun terpasang (settled) pada wahana dan mobil.
7. Jangka Waktu adalah masa berlaku Security Clearance dan/atau masa tugas Security Officer yang disetujui oleh Direktur Jenderal Strategi Pertahanan Kementerian Pertahanan.
8. Personel Surta adalah personel Indonesia maupun asing mendapat ijin dari instansi pemberi ijin.
9. Security Clearance yang selanjutnya disingkat SC adalah dokumen persetujuan, bukan merupakan perijinan, diterbitkan oleh Menteri Pertahanan, setelah mempertimbangkan aspek kedaulatan negara, pertahanan dan administratif, memuat jenis, lokasi kegiatan, personel, wahana, alat peralatan serta jangka waktu yang ditetapkan, sebagai wujud kebijakan Menteri Pertahanan dalam bidang pengamanan Surta, demi kepentingan pertahanan Negara, dengan mensinergikan pertahanan militer dan nirmiliter, sebagai landasan suatu kegiatan Surta yang dilaksanakan oleh Pemohon.
10. Security Officer yang selanjutnya disingkat SO adalah personel Tentara Nasional Indonesia berpangkat Perwira/Pegawai Negeri Sipil golongan III keatas berasal dari Kementerian Pertahanan maupun Tentara Nasional Indonesia (Angkatan Darat, Angkatan Laut, Angkatan Udara), yang memenuhi syarat keahlian/kecakapan/kompetensi di bidang Surta dan/atau pengamanan untuk melakukan pengawasan dan pengamanan pelaksanaan kegiatan terkait, agar sesuai dengan kegiatan yang tertera dalam SC.
11. Instansi Pemerintah adalah Kementerian, Lembaga Pemerintah Non Kementerian (LPNK), Badan Usaha Milik Negara/Daerah (BUMN/D), dan Pemerintah Daerah.
12. Pemohon SC dan SO selanjutnya disebut Pemohon adalah Pejabat sekurang-kurangnya setingkat Eselon II dari Kementerian, Lembaga Pemerintah Non Kementerian (LPNK), Badan Usaha Milik Negara/Daerah (BUMN/D), dan Pemerintah Daerah atau oleh Direksi lembaga yang mempunyai Badan Hukum Indonesia, berdomisili di Indonesia setelah memperoleh Izin/Surat Perintah Kerja (SPK)/Surat Perjanjian Kerja Sama (SPKS)/hak pengelolaan/konsesi dari instansi pemerintah terkait.
13. Daerah Terlarang/Terbatas adalah daerah yang di dalamnya tidak diijinkan/dilarang untuk melakukan kegiatan Surta.
14. Obyek Vital Nasional yang bersifat strategis adalah kawasan/lokasi, bangunan/instalasi dan/atau usaha yang menyangkut hajat hidup orang banyak, kepentingan Negara dan/atau sumber pendapatan Negara yang memiliki nilai strategis dari aspek pertahanan.
Translation - English Regulation of Director General of Defense Strategy No. 01/2014, dated 26 February 2014 concerning National Territory Survey and Mapping Security
In this Regulation, the following terms shall have the following meanings:
1. National Territory shall mean the State Territory and Jurisdiction Territory including aerial space above them.
2. Survey and Mapping hereinafter abbreviated SM shall mean an activity including collection of data (position, direction, height and depth in manual and digital form recorded on magnetic tape, film, compact discs, storage devices), recording, imaging, and processing thereof including research on phenomenon and condition of the earth’s surface or crust, including condition of water bottom and the earth's crust beneath it, and condition of the air, the printing of which can produce strategic data for the people welfare and the state defense.
3. Activity Security shall mean any efforts and actions taken by Security Officer to oversee and secure as well as investigate anything related to the conduct and completion of an activity, so that the activity runs in accordance with the Security Clearance.
4. Vehicle shall mean floating device/vessel or aircraft used to support the on-site activities, with Indonesian or foreign flag.
5. Survey Site shall mean a certain part of the entire National Territory.
6. Equipments shall mean all instruments of the activities used by personnel who directly performs on-site activities, either separately or settled on vehicle and car.
7. Term shall mean validity period of Security Clearance and/or service term of Security Officer approved by Director General of Defense Strategy (Ditjen Strahan) of Ministry of Defense (Kemhan).
8. SM Personnel shall mean any Indonesian and foreign personnel who obtains permission from the competent authority.
9. Security Clearance hereinafter abbreviated SC shall mean an approval document, but not a license, issued by Minister of Defense after considering the state sovereignty, defense and administrative aspects. It also states types, location of activities, personnel, vehicles, tools and equipments as well as the specific period, as realization of the Minister of Defense policy in field of SM security, for interests of the national defense, by synergizing military and non military defense, as the foundation of SM activities carried out by Applicant.
10. Security Officer hereinafter abbreviated SO shall mean a personnel of the Indonesian National Armed Forces with a rank of Officer/Civil Servant class III and above coming from the Ministry of Defense and the Indonesian National Armed Forces (Army, Navy, Air), who meets the required expertise/skill/competency in field of SM and/or safeguard for monitoring and securing the implementation of the relevant activities to conform to the activities listed in the SC.
11. Government Agencies shall mean Ministry, Non-Ministerial Government Institution (LPNK), Central Government Owned Enterprise (BUMN)/Local Government Owned Enterprise (BUMD), and Local Government.
12. SC and SO Applicant hereinafter referred to as Applicant shall mean an Officer at level of at least Echelon II/ second echelon of Ministry, Non-Ministerial Government Institution (LPNK), Central Government Owned Enterprise (BUMN)/Local Government Owned Enterprise (BUMD), and Local Government or a Director of an Indonesian Legal Entity, domiciled in Indonesia who has obtained Permit/Work Order (SPK)/ Cooperation Agreement (SPKS)/management/concession right from the relevant government agencies.
13. Restricted/Prohibited Area shall mean an area in which SM activity is not permitted.
14. Strategic National Vital Objects shall mean area/location, building/installation and/or business related to public necessities, the State’s interests and/or income having strategic value in view of defense aspect.
