Source text - English Section 4. PURCHASE COMMITMENT
4.1 PURCHASE COMMITMENT: During the term of this Agreement, DISTRIBUTOR will purchase and take delivery of Units on an as needed basis. Should MANUFACTURER fail to acknowledge or ship any Commitment established pursuant to this Agreement, DISTRIBUTOR may terminate this Agreement by giving MANUFACTURER notice in writing. If MANUFACTURER cures its default within such (thirty) (30) day period, the notice will be void. DISTRIBUTOR also has the further remedy, based upon failure by MANUFACTURER to acknowledge or ship any Commitment under this Agreement, of obtaining replacement Commitments that meet or exceed the same specifications of Commitments ordered. MANUFACTURER's right and DISTRIBUTOR’s right to terminate this Agreement under this Section 4 will be in addition to all other rights of MANUFACTURER and DISTRIBUTOR at law or in equity. No delay on the part of MANUFACTURER or DISTRIBUTOR in enforcing this Section 4 (whether or not intentional) will be construed as a waiver of the purchase Commitment set forth herein irrespective of the passage of time, except that MANUFACTURER or DISTRIBUTOR will have no right to act upon any default by DISTRIBUTOR or MANUFACTURER, respectively, under this Section 4 after DISTRIBUTOR or MANUFACTURER has cured such default.
Translation - German Abschnitt 4. ABNAHMEVERPFLICHTUNG
