بشأن رسوم البلدية على الإقامة في فنادق إمارة أبوظبي
نحن محمد بن زايد آل نهيان، ولي العهد رئيس المجلس التنفيذ
- بعد الإطلاع على قانون رقم (1) لسنة 1974بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي و القوانين المعدلة له.
- وعلى القانون رقم (9) لسنة 2007 في شأن إنشاء دائرة الشؤون البلدية.
- وبناء على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه.
- أصدرنا القرار التالي:
المادة الأولى
يُحصل رسم البلدية على الإقامة في فنادق الإمارة وذلك على النحو التالي:
• 4% من قيمة فاتورة النزيل.
• 15 درهم لكل ليلة عن كل غرفة.
تقوم هيئة أبوظبي للسياحة و الثقافة بتحصيل الرسوم و إيداع المبالغ في ميزانية الحكومة لصالح دائرة الشؤون البلدية.
المادة الثانية
يُلغى كل نص أو حكم يتعارض مع هذا القرار.
المادة الثالثة
يُنفذ هذا القرار من تاريخ صدوره وينشر في الجريدة الرسمية.

Translation - English Resolution of the executive chairman
No.(15) of 2016.
Regarding municipal’s fees for stays at hotels of Emirate Abu Dhabi.
We, Mohamed Bin Zayed Al Nahyan, the crown prince; the executive chairman.
- After taking into account law No.(1)of 1974 to reorganize intergovernmental machinery in Abu Dhabi Emirate and its amended laws.
- Taking into account also law No.(9) of 2007 concerning the establishment of municipal affairs department.
- Upon proposal submitted and agreed on by the executive council:
We resolve the following decision:
• Article 1
Municipality fees for residence in hotels of the emirate shall be collected as following:
-4% of the value of guest’s bill.
-15 dirham for room/night.
*Abu Dhabi Tourism& Culture Authority shall collect fees and deposit the amounts in government’s budget; for municipally affairs department.
• Article2
Every inconsistent or violating text or provision with the provisions of this decision shall be repealed .
• Article 3
This decision shall be in force upon the date of issuance, and shall be published in the official Gazette.

OF
NARESH TULJARAM RUPANI
I, Naresh Tuljaram Rupani, holding Indian nationality with passport number Z3797293 and Emirates ID: 784-1957-5821910-9, born on 7 April 1957, resident of Villa 11, Jumeirah 1, 28b Street, Dubai, United Arab Emirates, and being of sound mind and memory and not being actuated by duress, fraud, mistake or undue influence, do hereby make, publish and declare this to be my last Will and Testament (the “Will”) in connection with my Estate (defined below) situated in the United Arab Emirates.
DEFINITION OF MY ESTATE
For the purposes of this Will, the term “Estate” means (i) my legal and beneficial rights, interests and entitlements to all moveable or immoveable property; (ii) all my financial or other assets of any kind; (iii) all my bank accounts, including my interest, share or right in such bank accounts that are jointly owned by me; (iv) safety deposit boxes and lockers, jewellery, stocks, insurance policies, and vehicles; (v) all my financial investments, shares or other securities in any legal entities and other bonds or notes held by me from time to time representing property and/or assets of any kind.
APPLICATION OF LAW
It is expressly stipulated that this Will is made in accordance with Article 17 of the United Arab Emirates Federal Law No. 5 of 1985 relating to Civil Transactions (as amended) and accordingly any dispositions taking effect in connection with my Estate after my death shall be governed by the provisions contained in this Will.
I elect and do hereby declare to be a follower of Hinduism and request the Court that this Will and each and every disposition and provision contained herein shall be construed and regulated by and in accordance with the laws of India, the place of my domicile.
FAMILY CLAUSE
At the time of executing this Will, I am married to Seema Rupani, holding Indian nationality with passport number Z2920528 and Emirates ID: 784-1962-8021876-7 born on 19 April 1962.
I have two children. One son named Avinash Rupani, holding Indian nationality with passport number Z3278954 and Emirates ID: 784-1986-4285410-7 born on 21 September 1986, and one daughter named Karuna Rupani holding Indian Nationality with passport number Z2418808 and Emirates ID: 784-1985-9541651-6 born on 18 June 1985.
DISTRIBUTION CLAUSE
(A) I give, devise and bequeath 100% of my gross Estate to my wife Seema Rupani, after payment of my debts, expenses and taxes.
Provided that if my wife Seema Rupani does not survive me, I give, devise and bequeath the below mentioned beneficiaries 100% of my gross Estate after payment of my debts, expenses and taxes, in the percentages set forth below:
(a) Name: Avinash Rupani
Percent: 50.00%
Relationship: Son - Provided that if Avinash Rupani does not survive me, I give, devise and bequeath Avinash Rupani’s share in my gross Estate to the beneficiary nominated in sub paragraph (b) in this paragraph A in full.
(b) Name: Karuna Rupani
Percent:50.00%,
Relationship: Daughter - Provided that if Karuna Rupani does not survive me, I give, devise and bequeath Karuna Rupani’s share in my gross Estate to the beneficiary nominated in sub paragraph (a) in this paragraph A in full.
(B) If for any reason, none of the beneficiaries nominated in paragraph A above survive me, I give, devise and bequeath 100% of my gross Estate, after payment of my debts, expenses and taxes, to be distributed absolutely among my son Avinash Rupani’s and my daughter Karuna Rupani’s children in equal proportion.
Provided that if any one of my above-mentioned beneficiaries do not survive at the relevant time, I give, devise and bequeath such non-surviving beneficiary’s share in my gross Estate to the beneficiary surviving at the relevant time after payment of my debts, expenses and taxes.
EXECUTOR APPOINTMENT CLAUSE
(A) I nominate, constitute and appoint my son Avinash Rupani to be the executor and trustee of my Estate.
(B) If for any reason, Avinash Rupani fails to qualify or be unable or unwilling to accept or to continue as the executor and trustee of my Estate, I nominate, constitute and appoint my daughter Karuna Rupani to be the executor and trustee of my Estate.
(C) If for any reason, Karuna Rupani fails to qualify or be unable or unwilling to accept or to continue as the executor and trustee of my Estate, I nominate, constitute and appoint my relative, Nitin Kanjani, holding Indian nationality with passport number Z2922304 and Emirates ID: 784-1979-7928357-5, to be the executor and trustee of my Estate.
(D) If for any reason, Nitin Kanjani fails to qualify or be unable or unwilling to accept or to continue as the executor and trustee of my Estate, I nominate, constitute and appoint my relative, Pawan Kanjani, holding Indian nationality with passport number Z4975687 and Emirates ID: 784-1976-79-5, to be the executor and trustee of my Estate.

لأغراض الوصية الماثلة، يعني مصطلح "تركة" ما يلي (1) حقوقي ومصالحي القانونية والنفعية واستحقاقاتي بخصوص جميع الممتلكات المنقولة وغير المنقولة؛ (2) جميع أصولي المالية أو الأصول الأخرى من أي نوع؛ (3) جميع حساباتي البنكية متضمنة فوائدي أو أسهمي أو حقي في تلك الحسابات البنكية المملوكة بشكل مشترك من جانبي؛ (4) صناديق وخزانات الودائع والمجوهرات والأوراق المالية ووثائق التأمين والمركبات؛ (5) جميع استثماراتي المالية أو أسهمي أو الأوراق المالية الأخرى في أي كيان قانوني أو سندات أو أذون أخرى مملوكة لي من وقت لآخر تمثل ملكية و/ أو أصول من أي نوع.
تطبيق القانون
من المنصوص عليه صراحةً أن الوصية الماثلة محررة وفقًا للمادة 17 من القانون الاتحادي الإماراتي رقم 5 لعام 1985 بشأن المعاملات المدنية (وفقًا لتعديله) وبناءً عليه تخضع أي تصرفات فيما يتعلق بتركتي بعد وفاتي للأحكام الواردة في الوصية الماثلة.
أقر وأعلن بموجبه أنني تابع للديانة الهندوسية وأطلب من المحكمة تفسير وتنظيم الوصية الماثلة وكل تصرف وحكم وارد بموجبه وفقًا لقوانين الهند، محل إقامتي.

أنا متزوج، وقت تحريري للوصية الماثلة، من سيما روباني، مواطنة هندية، حاملة جواز سفر رقم: Z2920528 وهوية إماراتية رقم: 784-1962-8021876-7 مولودة بتاريخ 19 إبريل 1962.

(ب) الاسم: كارونا روباني
النسبة المئوية: 50.00%
العلاقة: ابنة – شريطة أنه في حالة وفاة كارونا روباني في حياتي، أعطي وأمنح وأوّرث حصة كارونا روباني بالكامل في تركتي الإجمالية على النحو المحدد في الفقرة (أ) الماثلة إلى المستفيد المحدد في الفقرة الفرعية (أ).
(ب) في حالة وفاة جميع المستفيدين الموضحين أعلاه في الفقرة أ لأي سبب، أعطي وأمنح وأوّرث 100% من تركتي الإجمالية بعد دفع الديون والنفقات والضرائب المستحقة عليّ، لتوزيعها بالتأكيد على أطفال ابني أفيناش روباني وابنتي كارونا روباني بنسب متساوية.
شريطة أنه في حالة بقاء أي من المستفيدين أعلاه على قيد الحياة في الوقت المناسب، أعطي وأمنح وأوّرث حصة المستفيد المتوفي في تركتي الإجمالية إلى المستفيد المتواجد على قيد الحياة في الوقت المناسب بعد دفع الديون والنفقات والضرائب المستحقة عليّ.
بند تعيين منّفذ الوصية
(أ) أرشح وأفوض وأعين ابني أفيناش روباني ليكون منفذ ووصي على تركتي.
(ب) في حالة عدم تأهل أفيناش روباني، لأي سبب، أو عدم قدرته أو عدم رغبته في قبول أو الاستمرار كمنفذ ووصي على تركتي، أرشح وأفوض وأعين ابنتي كارونا روباني لتكون منفذة ووصية على تركتي.
(ت) في حالة عدم تأهل كارونا روباني، لأي سبب، أو عدم قدرتها أو عدم رغبتها في قبول أو الاستمرار كمنفذة ووصية على تركتي، أرشح وأفوض وأعين أحد أقاربي نيتين كنجاني، مواطن هندي، حامل جواز سفر رقم: Z2922304 وهوية إماراتية رقم: 784-1979-7928357-5 ليكون منفذ ووصي على تركتي.
(ث) في حالة عدم تأهل نيتين كنجاني، لأي سبب، أو عدم قدرته أو عدم رغبته في قبول أو الاستمرار كمنفذ ووصي على تركتي، أرشح وأفوض وأعين أحد أقاربي باوان كنجاني، مواطن هندي، حامل جواز سفر رقم: Z4975687 وهوية إماراتية رقم: 784-1976-79-5 ليكون منفذ ووصي على تركتي.
