Source text - Romanian Capitolul IX – Cesiunea contractului
Art.39: Partile contractante nu vor putea cesiona drepturile si obligatiile prevazute in prezentul contract unei terte persoane, fara acordul expres, dat in scris, de catre cesionar.
Art.40: Acordul prevazut la articolul precedent, trebuie comunicat de catre cesionar, in termen de maxim 10 zile lucratoare, de la data cind cedentul i-a cerut acest acord. In caz contrar se presupune ca cesionarul nu a fost de acord cu cesiunea contractului.
Translation - English Chapter IX – Cession of Agreement
Art.39: The contracting Parties do not have the right to cede the rights and obligations resulting from the present Agreement to a third party without the written confirmation of the cessionary in this concern.
Art.40: The written confirmation mentioned under art.39, is to be transmitted to the cessionary within a period of maximum 10 working days as of the date on which the transferor asked for this confirmation. Otherwise, it is to be assumed that the cessionary did not agree with the cession of the Agreement.

Source text - German In der Polizeilichen Kriminalstatistik für das Jahr 2007 sind 632 Fälle von Wechselbetrug (vollendet und versucht) verzeichnet.
Zahlenmäßig weitaus häufiger sind Betrügereien mittels Karten, die zur Bezahlung im Wege des Lastschriftverfahrens vorgelegt werden.
Der Vorlegende nimmt billigend in Kauf oder weiß, dass sein Konto nicht über eine ausreichende Deckung verfügt, oder er hat sich eine fremde Karte durch Diebstahl oder auf anderem Wege beschafft.
Häufig werden gestohlene Karten in einer Vielzahl von Fällen eingesetzt.
Die Anzahl der in der Polizeilichen Kriminalstatistik 2007 verzeichneten Fälle des Betruges und versuchten Betruges mit rechtswidrig erlangten unbaren Zahlungsmitteln beträgt insgesamt 72 191.
Betrug im Zusammenhang mit Hingabe eines Schecks:
Hingabe eine Schecks beinhaltet die konkludente Erklärung des Scheckausstellers, dass der Scheck bei Einlösung (Vorlage bei der bezogenen Bank) gedeckt ist, d.h. hinreichende Kontodeckung bestehen wird.
Im Einzelfall kann auch schon Deckung im Zeitpunkt der Übergabe des Schecks erklärt sein.
Der Schecknehmer geht davon aus, dass der Scheck gedeckt ist.
Unter dem Gesichtspunkt des Eingehungsbetruges ist entscheidend, ob der Schecknehmer für seine Leistung einen wirtschaftlich minderwertigen Anspruch gegen seinen Geschäftspartner hat.
Ein Vermögensschaden liegt bei Vorspiegelung der Deckung schon bei Hingabe des Schecks vor, wenn zu diesem Zeitpunkt eine Deckung zum Zeitpunkt der Vorlage unsicher bzw. nicht hinreichend sicher zu erwarten ist (Gefährdungsschaden).
Translation - Romanian În evidenţele criminalistice ale poliţiei pentru anul 2007 sunt consemnate 632 cazuri de înşelăciune cu cambii (reuşite sau tentative).
Din punct de vedere al cifrelor, sunt mult mai des întâlnite înşelăciunile prin intermediul cărţilor de credit care sunt prezentate la plata prin debit direct.
Cel care efectuează plata ia în considerare sau este conştient de faptul că nu dispune de o acoperire suficientă, sau şi-a însuşit o carte de credit străină prin furt sau prin alte căi.
Adeseori sunt folosite cărţile de credit furate într-o multitudine de cazuri.
În evidenţele criminalistice ale poliţiei pentru anul 2007, numărul cazurilor consemnate de înşelăciune sau tentativă de înşelăciune cu mijloace de plată diferite de numerar obţinute în neconcordanţă cu legea, este de 72 191.
Înşelăciunea în legătură cu emiterea unui cec:
Emiterea unui cec conţine declaraţia concludentă a emitentului că cecul va avea acoperire la plată (exemplarul original se află la banca plătitoare), deci contul va dispune de acoperirea necesară efectuării plăţii.
În cazuri singulare acoperirea cecului poate fi declarată şi în momentul depunerii cecului.
Persoana care lichidează cecul pleacă de la premisa că cecul are acoperire.
Din punctul de vedere al contractării frauduloase este decisiv dacă persoana care lichidează cecul are pretenţii fără pondere economică faţă de partenerul său de afaceri.
Daunele materiale sunt create prin iluzia acoperirii deja de la depunerea cecului, atunci când în momentul respectiv există suspiciuni cu privire la siguranţa acoperirii acestuia la momentul încasării (daună prin periclitare).
