Hello,

I don't know what to do regarding this situation, so I decided to write you.

I have been working to a Spanish outsourcer (who is reported as a BlueBoard quick and reliable payer)...

Hello,

I don't know what to do regarding this situation, so I decided to write you.

I have been working to a Spanish outsourcer (who is reported as a BlueBoard quick and reliable payer)...

First, he asked me to do the translation of a website and paid really fast; then he asked me to perform other translations, as well as 5 comic books... He mentioned that the payment terms would be 45 days via bank transfer... The truth is that more than 70 days have passed and he doesn't carry out the payments. I have already contacted him and he said he would pay this week and the next one. However, I haven't heard from him since. And the outstanding amount is over 800 EUROS.

Is there anything I can do concerning late payers?
If he is reported as a fast payer why is that he is taking ages to pay?

I am getting really impatient and tired of this situation especially because I don't know anymore if I should rely on this outsourcer.

Report it in the Blueboard Mar 4, 2010

First of all, report this behaviour in the Blueboard, so that other people know how this company really behaves. Let the customer know that unless a payment is received at once, you will have no option but to add a bad entry to the Blueboard. If they don't pay in a week, post the negative comment and let them have it.

Additionally, warn this company that you will sue them unless the pay at once. One option is to start a European Small Claims procedure (in Spanish, «un proceso monit

Additionally, warn this company that you will sue them unless the pay at once. One option is to start a European Small Claims procedure (in Spanish, «un proceso monitorio») against them unless you are paid at once. The «monitorio» will unfortunately take a very long time (probably over a year), so do give them the chance to correct this situation. If they don't pay --they might even be offended by your warning and might decide not to pay at all and let you do the «monitorio»--, they will have to pay in the end, but the process will cost them more than paying now.

Another, probably more practical approach would be to call them twice a day until they have paid. Becoming a nuisance does help with Spanish companies!

I think that, even if the end up paying, it would be a good thing to post a less-than-ideal score in the Blueboard (for instance a 2-3) with no comment, so that others are warned that the company did not have a good behaviour with you and can take protective measures, for instance require advance payment if the volume with them starts to grow.

Definitely don't wait one or two weeks! I am so shocked that you have waited so long already. I always contact clients 2 days after the payment was due with a reminder, and if they haven't paid it by day 3 I contact them every single day until they pay it. Some outsourcers seem to have a very relaxed attitude when it comes to paying translators and seem to think that it is okay to pay after the invoice is due. I always contact clients 2 days after the payment was due with a reminder, and if they haven't paid it by day 3 I contact them every single day until they pay it. Some outsourcers seem to have a very relaxed attitude when it comes to paying translators and seem to think that it is okay to pay after the invoice is due. I think it is completely unacceptable for the invoice to be even a day overdue, after all they wouldn't be pleased if we broke our part of the contract by delivering the translation a day late.

I think persistence is key. I always insist that they pay the invoice immediately and that I expect to see the money in my account that same day or else they must send me a receipt from their bank confirming that the payment has been made. Also, remind them that you are entitled to charge them interest on overdue payments in accordance with EU law.

I agree with Tomas that being a nuisance really pays off, so make it clear to them that you intend to email and call them constantly until they pay you. And please leave them a bad score (I would suggest a 1, given that your invoice is now over 25 days overdue and they have stopped communicating with you!).

I wouldn't trust the outsourcer or work with them again if I were you. It says a lot about their attitude and reliability when they think it is okay to not pay you for over 25 days and also ignore you!

Best of luck with getting them to pay up, it’s the most frustrating feeling in the world when you have to chase someone just to get them to complete their part of the bargain when you have already done yours.

Thank you all for your wise and experienced advice.

The client said he would pay me one week and that he would pay the next week and wanted me to accept more work which I refused in order to prevent the invoice from growing any bigger...

I am quite anxious and impatient about this as this is a high amount (over 800 EUR).

That is not the impression you give. Patience is what you have shown for too long a time. Why are you thinking about waiting another week or two? What makes you believe that the outsourcer will pay within that time? Nothing indicates so. Get going, start pestering them, or kiss your money good-bye.

Hello,

Yesterday I contacted one of his translators and she said that this company takes ages to pay (but they pay in the end) and never meet deadlines as far as payments are concerned... She said that she knows a few fellow translators who are in the same situation as mine. She also advised me to kept on insisting and send emails everyday...

Emails are no good Mar 6, 2010

Emails are no good. It takes me 1 second to delete an email I don't want to see. But calls are a lot more effective because there is no way you can escape from A) spending 2-3 minutes trying to reassure the caller that everything will be fine or B) constantly thinking that you can receive an unwanted call at any time of the day.
