Dear colleagues,

I am writing this on behalf of my friend.

She works as a freelance translator in the UK and one of her clients asked her to put VAT number in her invoice. But, she hasn’t registered for VAT as she doesn’t earn more than £70,000 annually.

Then, her client has asked her to provide the following information:

We ask you to state if you are liable to tax. If you are not, your invoice has to include the following sentence:

Directly after the total invoice amount, simply write "VAT not applicable in accordance with UK law".

End of story.

HMRC Notice 700 Jun 3, 2011

Agree with Tom. That wording is legally required on both quotes and invoices in France, and the specific article of law must be mentioned. So if the client insists on more precision, unless I am mistaken, the turnover threshold is defined in HMRC Notice 700 (February 2011).

Thank you for your kind answer but as my friend says unfortunately, that is not enough. She needs to provide this information: VAT not applicable, art. XX (insert article of your respective tax law) of YYY (insert name of your national tax law), member of a micro-enterprise tax regime."

This is what my invoices say Jun 3, 2011

"Prestations de services non soumises à la TVA belge, Art.21 §2, C.TVA – Article 44, Directive 2006/112/CE"

you are free to adapt it...

What I suggested is enough for the UK tax authorities. Your friend should not be doing what her client is telling her to do, but what the UK tax authorities require.

What I have suggested is what I put on all my own invoices. I would not accept any request to put anything else.

I suggest your friend consult a UK accountant, as you will probably be given lots of different opinions here.

It is important that your invoices be correctly worded for the UK tax authorities.

"In accordance with **Schedule 1 to the Value Added Tax Act 1994, in conjunction with the Value Added Tax (Increase of Registration Limits) Order 2007**, no VAT is chargeable as total annual turnover is below the minimum UK threshold for VAT registration."

So unless things have changed since I was asked to include that on my invoices, that should be the applicable UK legislation. I would advise your friend to check
