This is a very difficult French legal text containing several terms that I just can't find. Here is the context: "Il soutient que la nullité de la garde à vue a pour conséquence la nullité du procès verbal de saisine du tribunal correctionnel en date du 1er octobre, dès lors que la garde à vue en constitue le support nécessaire, en se prévalant à cet égard de la solution dégagée par la chambre criminelle de la Cour de cassation dans un arrêt du 6 décembre 2005, ..." Here's my stab at it - needs to be refined but the meaning should be correct - although what is throwing me off is your reference to Patent law!
"He maintains that the nullity of the policy custody results in the nullity of the referal to the criminal court of October 1, since the police custody forms the basis thereof, resting his argument on the solution issued by the criminal division of the Court of Cassation in its decision dated December 6, 2005".

Saisine: referral to a higher court (or criminal court) in the context of an appeal
Procès verbal: I would not translate in this case, it is encompassed in the term "referral" in English.
