Source text - French L’économie marchande privée constitue aujourd’hui la composante la plus importante de l’économie réelle. Elle est donc soumise à toutes les attentions et doit répondre aux sollicitations les plus diverses qui proviennent non seulement des apporteurs de capitaux et de travail, mais aussi des autorités publiques et d’une multitude de groupes issus des sociétés civiles qui exigent d’elle d’assurer la croissance économique tout en ménageant les équilibres sociaux et en respectant les ressources naturelles qu’elle utilise pour son activité. Ces exigences se portent concrètement sur les entreprises et le monde des affaires auxquels il est demandé de rendre compte de leurs comportements en faisant référence à leur responsabilité, comme si cette notion, conçue à l’origine pour les personnes, devait s’appliquer à des collectivités humaines à finalité économique, traversées de nombreuses contradictions et dont les contours sont, au demeurant, difficiles à cerner. Dans un contexte de mondialisation de l’activité économique et des échanges, les risques de marchandisation atteignent des secteurs de la vie sociale et culturelle qui font craindre une déshumanisation progressive des liens sociétaux. A l’inverse, la sphère marchande se trouve parfois investie de tâches qui pourraient relever des compétences des pouvoirs publics surtout lorsqu’il s’agit de répondre à des besoins essentiels des populations. Les zones de responsabilité ne connaissent donc plus de frontières étanches et il est même souvent difficile de les distinguer.
Certes, la question des rapports entre l’organisation sociale et l’activité économique a toujours été présente dans l’histoire de l’humanité, mais la focalisation actuelle sur les responsabilités des organisations économiques ne serait pas aussi prégnante sans l’existence d’un double phénomène interactif :
d’une part, la société civile a relevé son seuil d’acceptabilité des risques pour différentes raisons (montée de l’individualisme, peurs collectives plus ou moins justifiées, et surtout prise de conscience plus aiguë de périls majeurs pour la planète : guerres localisées mais nombreuses, persistance de la pauvreté et aggravation des inégalités, mouvements migratoires importants et incontrôlés, changements climatiques aux effets dévastateurs…) ;
d’autre part, les entreprises (notamment les firmes multinationales qui atteignent des tailles gigantesques) connaissent une grave crise de légitimité et sont en quête de regain de confiance auprès de la société civile.
Il n’y a pas lieu d’opposer la société civile et les entreprises de manière manichéenne, mais de tenter de redéfinir de nouveaux modes de régulation entre elles, ce qui passe par de nouvelles modalités de dialogue et de concertation.
L’objet de ce texte sera donc tout d’abord de clarifier le concept de responsabilité d’entreprise qui apparaît aujourd’hui sous des appellations diverses dans de nombreux discours. La notion de corporate social responsibility qui vient du monde anglo-saxon a été la plupart du temps traduite en français par « responsabilité sociale de l’entreprise », mais elle ne rend pas nécessairement compte de la dimension globale de cette responsabilité (économique, sociale, environnementale, culturelle, sanitaire, …). Le terme « social » en français (surtout lorsqu’il s’applique aux entreprises) est souvent entendu dans un sens restreint : à savoir ce qui concerne la vie au travail des salariés. C’est la raison pour laquelle on a tendance à préférer maintenant l’expression « responsabilité globale de l’entreprise » et parfois « responsabilité sociétale de l’entreprise » pour bien marquer la différence entre une conception réduite à la dimension interne des entreprises et une dimension beaucoup plus large embrassant toutes les relations de l’entreprise et tous les effets sur son environnement humain, social et biophysique.
Dans un souci de simplicité, nous avons préféré utiliser le concept de « responsabilité d’entreprise » qui permet d’englober aussi l’ensemble des acceptions. Néanmoins, nous serons ainsi amenés à utiliser indistinctement les autres expressions afin de respecter la formulation des auteurs ou les contextes dans lesquels elles sont utilisées. L’éclairage des théories économiques et sociologiques permettra ensuite de fournir des clés d’interprétation sans lesquelles il est bien difficile de comprendre les raisons d’agir des différents acteurs. Cet éclairage concernera principalement l’explication des motivations des firmes et de leur management. Mais l’examen de la promotion du concept de responsabilité d’entreprise sera l’occasion de passer en revue les logiques des principaux autres acteurs de la relation entreprises/société.
Enfin, une partie importante sera consacrée à la présentation des dispositifs de mise en oeuvre de la responsabilité d’entreprise, en mettant l’accent sur leurs apports et leurs limites. En guise de conclusion (provisoire), les enjeux d’une régulation internationale seront mis en exergue, suivis de recommandations pour le programme Ethique de l’économie de l’UNESCO.
Translation - Romanian Economia comercială privată constituie azi componenta cea mai importantă din economia reală. Ea este deci supusă tuturor atenţiilor şi trebuie să răspundă solicitărilor celor mai diverse, care provin nu numai din aducătorii de capital şi de forţă de muncă, dar şi de la autorităţile publice şi de la o multitudine de grupuri provenite din societăţi civile care cer ca aceasta să asigure creşterea economică oferind în acelaşi timp echilibrul social şi respectând resursele naturale pe care le utilizează pentru activitatea sa. Aceste exigenţe sunt în mod specific în companii şi în mediul de afaceri, în care se cere să ne dăm seama de comportamentele lor, făcând referinţă la responsabilitatea lor, ca şi cum această noţiune, concepută iniţial pentru oameni, ar trebui să se aplice la colectivităţi umane cu finalitate economică, trecute prin numeroase contradicţii şi ale căror contururi sunt de altfel, greu de definit. Intr-un context de mondializare a activităţii economice şi a schimburilor, riscurile de comercializare ating sectoare ale vieţii sociale şi culturale care se tem de o dezumanizare treptată a obligaţiilor sociale. In schimb, sfera comercială se găseşte investită de sarcini care ar putea releva competenţe ale puterilor publice, mai ales dacă este vorba de a răspunde nevoilor esenţiale ale populaţiilor. Zonele de responsabilitate nu cunosc deci mai multe frontiere impermeabile şi este chiar adesea dificil să le distingem.
Desigur, problema raporturilor între organizaţia socială şi activitatea economică a fost întotdeauna prezentă în istoria umaniăţii, dar focalizarea actuală asupra responsabilităţilor organizaţiilor economice nu ar fi atât de evidentă fără existenţa unui dublu fenomen interactiv :
De o parte, societatea civilă a ridicat pragul de acceptabilitate a riscurilor pentru diferite motive (creşterea individualismului, temeri colective mai mult sau mai puţin justificate şi mai ales conştientizarea mai acută a pericolelor majore pentru planetă : războaie localizate, dar numeroase, persistenţa sărăciei şi agravarea inegalităţilor, mişcări migratoare importante şi necontrolate, schimbări climatice cu efecte devastatoare…) ;
De altă parte, companiile (în special firmele multinaţionale care ajung la dimensiuni enorme) cunosc o criză gravă de legitimitate şi sunt în căutarea recâştigării încrederii în rândul societăţii civile.
Nu există niciun motiv să opunem societăţii civile şi companiile, într-o manieră maniheistă, dar să încercăm să redefinim din nou modurile de reglare între ele, ceea ce trece prin modalităţi noi de dialog şi de concentrare.
Obiectul acestui text va fi deci, întâi de clarificare a responsabilităţii companiei care astăzi apare sub apelative diverse în discursuri numeroase. Noţiunea de responsabilitate socială corporate care provine din mediul anglo-saxon a fost majoritatea timpului tradusă în limba franceză prin « responsabilitate socială a companiei», dar ea nu reflectă neapărat dimensiunea globală a acestei responsabilităţi (economică, socială, de mediu, culturală, sanitară, …). Termenul « social » în franceză (mai ales deoarece se aplică întreprinderilor) este adesea înţeles într-un mediu restrâns : şi anume ceea ce înseamnă viaţa profesională a angajaţilor. Este motivul pentru care avem tendinţa să preferăm să menţinem expresia « responsabilitate globală corporatistă» şi poate « responsabilitate socială corporatistă » pentru a marca bine diferenţa între concepţia redusă a dimensiunii interne a companiilor şi o dimensiune mult mai largă care să cuprindă toate relaţiile întreprinderii şi toate efectele asupra mediului său uman, social şi biofizic.
Din motive de simplitate, noi am preferat să utilizăm conceptul de « responsabilitate corporativă » care permite înglobarea, de asemenea, a ansamblului accepţiilor. Cu toate acestea, suntem prin urmare conduşi să utilizăm indistinct celelalte expresii pentru a respecta formularea autorilor sau contextelor în care acestea au fost utilizate. Clarificarea teoriilor economice şi sociologice va permite apoi furmizarea unor chei de interpretare fără care este foarte dificil să înţelegem motivele pentru acţiunea diferiţilor autori. Această clarificare va implica în principal explicarea motivaţiilor firmelor şi managementul lor. Dar examenul de promovare al conceptului de responsabilitate corporativă va fi ocazia de a trece în revistă logica altor actori principali ai relaţiei companie/societate.
In sfârşit, o parte importantă va fi consacrată prezentării dispozitivelor de punere în aplicare a responsabilităţii corporative, punând accent pe avantaje şi limite. In concluzie (provizorie), provocările pentru reglementările internaţionale vor fi evidenţiate urmate de recomandările pentru programul Etica economiei UNESCO.

Source text - Romanian Studiul de siguranţă trebuie să conţină suficiente informaţii despre instalaţie pentru a se putea verifica dacă politica de proiectare şi operare corespunde Sistemului de management al siguranţei (SMS) precum şi premisele şi rezultatele procesului de evaluare a riscului.
Descrierea instalaţiei trebuie să conţină cel puţin următoarele informaţii:

- o descriere a structurii, a caracteristicilor sale unice (dacă există) şi a dispunerii echipamentului pentru toate instalaţiile;
