Source text - English The Court dismisses the appeal lodged by Telefónica and Telefónica de Espaħa concerning its abuse of a dominant position on the Spanish broadband market
EU law prohibits any abuse by undertakings of a dominant position on the internal market or on a substantial part of it, in so far as trade between Member States is liable to be affected by such abuse.
After receiving a complaint, the Commission declared, by decision of 4 July 2007, that Telefónica and Telefónica de Espaħa (‘Telefónica’) had abused their dominant position by imposing unfair prices on their competitors in the form of a margin squeeze between the prices for retail broadband access on the Spanish ‘mass market’ and the prices on the regional and national wholesale broadband access markets throughout the period from September 2001 to December 2006. The Commission considered that there was clear-cut abuse on the part of an undertaking holding a virtual monopoly and that the abuse was to be classified as ‘very serious’. A fine of €151 875 000 was therefore imposed on Telefónica, the starting amount of the calculation being set at €90 million.
Telefónica brought proceedings against the Commission’s decision before the General Court.
By judgment of 29 March 2012, the General Court dismissed the action.
Translation - Czech Soudní dvůr zamítá odvolání podané společnostmi Telefónica a Telefónica de Espaħa o zneužívání jejich dominantního postavení na španělském širokopásmovém trhu
Právo EU zakazuje zneužití dominantního postavení podniku na vnitřním trhu nebo na jeho významné části, pokud toto zneužití může ovlivnit obchod mezi členskými státy.
Po obdržení stížnosti Komise rozhodnutím ze 4. června 2007 prohlásila, že společnosti Telefónica a Telefónica de Espaħa („Telefónica“) v období od září 2001 do prosince 2006 zneužily svého dominantního postavení stanovováním nepřiměřených cen zmenšováním rozpětí mezi maloobchodní cenou širokopásmového přístupu na španělském „masovém trhu“ a velkoobchodní cenou širokopásmového přístupu na regionální a celostátní úrovni. Komise se domnívá, že došlo k jednoznačnému zneužití ze strany podniku s faktickým monopolním postavením, a že zneužití má být hodnoceno jako „velmi závažné“. Společnosti Telefónica byla tudíž uložena pokuta ve výši 151 875 000 €, kalkulace začala na 90 milionech euro.
Telefónica podala návrh na zahájení řízení proti rozhodnutí Komise u Tribunálu.
Tribunál žalobu zamítl rozsudkem z 29. března 2012.
