Ako svedka Vás poučujem:
Podľa § 127 Trestného poriadku ste povinný vypovedať ako svedok o tom, čo je Vám známe o trestnom čine a o páchateľovi alebo o okolnostiach dôležitých pre trestné konanie.
Podľa § 130 odsek 1 Trestného poriadku máte právo odoprieť výpoveď ako svedok, ak ste príbuzný obvineného v priamom rade, jeho súrodenec, osvojiteľ, osvojenec, manžel alebo druh. Ak je viac obvinených a ste v uvedenom pomere len k niektorému z nich, máte právo odoprieť výpoveď ohľadne iných obvinených len vtedy, keď nemožno oddeliť výpoveď, ktorá sa ich týka, od výpovede týkajúcej sa obvineného, s ktorým ste v tomto pomere. Podľa § 130 odsek 2 Trestného poriadku ste oprávnený odoprieť vypovedať, ak by ste svojou výpoveďou spôsobili nebezpečenstvo trestného stíhania sebe, svojmu príbuznému v priamom rade, svojmu súrodencovi, osvojiteľovi, osvojencovi, manželovi alebo druhovi alebo iným osobám v rodinnom alebo obdobnom pomere, ktorých ujmu by ste právom pociťovali ako vlastnú ujmu.
Podľa § 131 odsek 1 Trestného poriadku Vás poučujem o význame svedeckej výpovede a o tom, že ste povinný vypovedať úplnú pravdu a nič nezamlčať.
Je trestné v zmysle § 344 Trestného zákona ak predložíte dôkaz, o ktorom viete, že je sfalšovaný alebo pozmenený, na účel použiť ho ako pravý; falšovať, pozmeniť alebo mariť dôkaz alebo brániť v získaní dôkazu; mariť alebo brániť prítomnosti alebo výpovedi strany trestného konania, účastníka súdneho konania, svedka, znalca, tlmočníka alebo prekladateľa, alebo použiť násilie, hrozbu násilia alebo hrozbu inej ťažkej ujmy alebo sľúbiť, ponúknuť alebo poskytnúť neoprávnenú výhodu a tak pôsobiť na stranu trestného konania, svedka, znalca, tlmočníka, prekladateľa alebo na orgán činný v trestnom konaní.
Tiež je trestné v zmysle § 345 Trestného zákona, ak iného lživo obviníte z trestného činu v úmysle privodiť jeho trestné stíhanie.
Translation - English Instruction of witness
As a witness you are instructed:
Under Section 127 of the Code of Criminal Procedure you are obliged to give testimony as a witness on facts known to you on the offence and the offender and on the circumstances relevant to the criminal proceeding.
Under Section 130 (1) of the Code of Criminal Procedure you have right to refuse to give the testimony as a witness if you are relative of the accused in direct line, their sibling, foster parent, foster child, spouse or common-law spouse. If there are several accused persons and you are relative only to one of them, you have right to refuse to give testimony with regard to other accused exclusively in case it is impossible to separate such testimony from the testimony with regard to the accused relative to you. Pursuant to Section 130 (2) of the Code of Criminal Procedure you have right to refuse to give testimony provided it might cause criminal prosecution of your person, your relative in direct line, your sibling, step parent, step child, spouse or common-law spouse or of other relatives or persons in similar relationship whose harm you would rightfully perceive as your own harm.
Under Section 131 (1) of the Code of Criminal Procedure I instruct you on the importance of the testimony and on the fact that you are obliged to tell the truth and conceal nothing.
In compliance with Section 344 of the Criminal Code it is punishable if you present the evidence you know it be forged or altered with the purpose of presenting it as genuine. Furthermore, it is punishable to forge, alter or impede the evidence or obstruct taking the evidence, obstruct the presence or the testimony of a party to the criminal proceeding, a participant in criminal proceeding, a witness, an expert witness, an interpreter or a translator or to use violence, threat of violence or threat of any other serious harm or to promise, offer or provide unauthorised benefit and thereby influence a party to the criminal proceeding, a witness, an expert witness, an interpreter or a translator or a prosecution authority.
Under Art. 245 of the Criminal Code it is also punishable if you falsely accuse a person of criminal offence with the intention to cause their criminal prosecution.
