Translation - English I. What is an Elder Care Trust?
(1) What is a Trust?
Let's first clarify the meaning of a 'Trust' before we delve into the specifics of an Elder Care Trust. In the context of a trust, a settlor entrusts their property to a trustee, who is then obligated to manage the property and care for the beneficiary or beneficiaries, all in accordance with the terms set out in their mutual agreement or the settlor's will. In addition, a trust supervisor can also be appointed to oversee the trustee, act for and on behalf of the beneficiaries, and ensure smooth execution of the trust. For example, an individual could sign a trust contract with a bank to manage their pension. The bank would then disburse NT$20,000 to them every month for living expenses, safeguarding the pension from potential misuse or fraud. The individual’s son and daughter could be appointed as co-trust supervisors.
(II) Elder Care Trusts for the Elderly and People with Disabilities
Broadly speaking, an Elder Care Trust is a system designed to “secure the quality of life for the elderly during retirement”. At the moment, many local institutions, including banks approved by the competent authority to conduct concurrently trust businesses (hereinafter referred to as "financial institutions"), have begun to introduce various trust services in response to an aging society. These services range from retire-with-a-leased-house trusts to securities and real estate trusts, offering the elderly with different types of assets the opportunity to be supported by a trust.
In a narrower sense, an “Elderly Care Trust”, implemented by financial institutions with the encouragement of the Financial Supervisory Commission, must simultaneously meet the following conditions:
1. The purpose of establishing the trust is to facilitate elder care, which includes asset management, nursing care, and reimbursement of medical expenses for the elderly;
2. One of the beneficiaries must be over 55 years old;
3. The trust should not be established solely for investing in domestic and foreign securities via money trusts.
In addition to the elderly, people with disabilities as defined in Article 5 of the People with Disabilities Rights Protection Act can also be beneficiaries of an Elder Care Trust, according to Article 6 of the Trust 2.0 Phase 2 Plan Evaluation and Incentive Measures. Therefore, the scope of the Elder Care Trust includes both people with disabilities and the elderly.
