الموضوع الأول: بيان حرمة المسلم و وجوب تكريمه حيا أو ميتا و عصمة دمه
و وجوب حقنه حيا:
ثبتت عصمة دم المسلم بالكتاب و السنة و إجماع الأمة، فلا يحل لأحد أن يسفك دم
مسلم أو يجني على بشرته أو عضو من أعضائه إلا إذا ارتكب من الجرائم ما يبيح ذلك
منه أو يوجبه شرعا، كأن يقتل مؤمنا عمدا عدوانا، أو يزني و هو محصن، أو يترك دينه
و يفارق الجماعة، أو يحارب الله و رسوله، و يسعى في الأرض فسادا، أو نحو ذلك مما
أوحيت الشريعة فيه قصاصا أو حدا أو تعزيرا، قال الله تعالى: (و ما كان لمؤمن أن يقتل مؤمنا إلا
خطأ ومن قتل مؤمنا خطأ فتحيرير رقبة مؤمنة و دية مسلمة إلى أهله إلا أن يصدقوا) إلى قوله تعالى:
(و من يقتل مؤمنا متعمدا فجزاؤه جهنم خالدا فيها وغضب الله عليه ولعنه وأعد له عذابا عظيما) وقال
تعالى: (ولا تقتلوا النفس التي حرم الله إلا بالحق ومن قتل مظلوما فقد جعلنا لولية سلطانا فلا يسرف
في القتل إنه كان منصورا)
وعن أبي بكرة رضي الله عنه قال: (خطبنا النبي صلى الله عليه وسلم يوم النحر، قال: أتدرون أي يوم
هذا؟

قلنا: الله ورسوله أعلم، فسكت حتى ظننا أنه سيسميه بغير اسمه. قال: أليس يوم النحر؟ قلنا: بلى.
قال: أي شهر هذا؟ قلنا: الله ورسوله أعلم، فسكت حتى ظننا أنه سيسميه بغير اسمه. قال: أليس ذي
الحجة؟ قلنا: بلى. قال: أي بلد هذا؟ قلنا: الله ورسوله أعلم، فسكت حتى ظننا أنه سيسميه بغير اسمه.
قال: أليست بالبلدة الحرام؟ قلنا: بلى. قال: فإن دماءكم وأموالكم عليكم حرام كحرمة يومكم هذا، في
شهركم هذا، في بلدكم هذا، إلى يوم تلقون ربكم، ألا هل بلغت؟! قالوا: نعم. قال: اللهم اشهد، فليبلغ
الشاهد الغائب فرب مبلغ أوعى من سامع، فلا ترجعوا بعدي كفارا يضرب بعضكم رقاب بعض).
وعن ابن مسعود قال: قال صلى الله عليه وسلم: (لا يحل دم امرئ مسلم يشهد أن لا إله إلا الله وأني
رسول الله إلا بإحدى ثلاث: النفس بالنفس، والثيب الزاني، والمارق من الدين، التارك الجماعة).

كما وردت نصوص كثيرة في تكريمه ورعاية حرمته بعد موته: ففي [سنن أبي داود] وغيره: أن النبي صلى
الله عليه وسلم قال: (كسر عظم الميت ككسره حيا) وثبت (أن النبي صلى الله عليه وسلم نهى عن الجلوس على
القبور).
إلى غير ذلك مما تدل على عصمة دم المسلم، ووجوب تكريمه حيا أو ميتا، حتى صار ذلك معلوما من
الدين باضرورة، فأغنى عن الاستدلال عليه.
ويلتحق بالمسلم في عصمة دمه وحرمته في الجملة من كان معاهدا، سواء كان عهده عن صلح أو أمان أو
اتفاق على جزية، فلا يحل دمه ولا إيذاؤه ما دام فى عهده، ولا تحل إهانته بعد وفاته؛ لعموم قوله تعالى:
(وأوفوا بعهد الله اذا عاهدتم ولا تنقضوا الأيمان بعد توكيدها وقد جعلتم الله عليكم كفيلا إن الله يعلم ما
تفعلون)(ولا تكونوا كالًتى نقضت غزلها من بعد قوة أنكانا تتخذون أيمانكم دخلا بينكم أن تكون أمًة هي
أربى من امًة إنما يبلوكم الله به وليبينن لكم يوم القيامة ما كنتم فيه تختلفون)
وقوله: (وأؤفوا بالعهد إن العهد كان مسئولا) ولما ثبت ان رسول الله صلى وسلم قال: (من
قتل معاهدا فى غير كنهه حرم الله عليه الجنة)
وقال: ( من قتل نفسا معاهدا لم يرح رائحة الجنة، وإن ريحها ليوجد من مسيرة أربعين عاما)

وما ثبت في حديث علي رضى الله عنه، عن النبى صلى الله عليه وسلم أنه قال: ( ألا لا يقتل مؤمن
بكافر ولا ذو عهد في عهده، من أحدث حدثا فعلى نفسه، ومن أحدث حدثا أو آوى محدثا فعليه لعنة الله
والملائكة والناس أجمعين)
وما رواه أبو داود في [سننه] عن سليم بن عامر – رجل من حمير – أنه كان بين معاوية وبين الروم عهد،
وكان يسير نحو بلادهم ، حتى إذا انقضى العهد غزاهم، فجاء رجل على فرس أو برذون وهو يقول: الله أكبر،
الله أكبر، وفاء لاغدر، فنظروا فإذا هو عمرو بن عبسة، فأرسل إليه معاوية، فسأله، فقال: سمعت رسول
الله صلى الله عليه وسلم يقول: ( من كان بينه وبين قوم عهد فلا يشد عقدة ولا يحلها حتى ينقضي
أمدها، أو ينبذ إليهم على سواء ) فرجع معاوية.
بل جاء الإسلام بحقن دماء أولاد الكفار المحاربين ونسائهم، وتحريم التمثيل بقتلاهم في الجملة عدلا منه
ورحمة، كما هو معروف في حديث بريدة بن الحصيب وغيره في ذلك.
وفي [سنن أبي داود] وغيره: أن النبي صلى الله عليه وسلم قال: (كسر عظم الميت ككسره حيا!)

Bismillah ar-Rahman ar-Raheem
In the name of Allah, the most Beneficent, the most Merciful.
The first topic: the statement of the sanctity of Muslim and the necessity of his honoring whether alive or dead and saving his blood and the necessity of his protection in life:
The protecting of Muslim blood has been verified through the Holy Book, Hadith and through the consensus of the Muslim nation. No one can shed blood of Muslim or harm his skin or any part of the body, except when a person commit any crime that permit doing so, or make it obligatory according to the Sharia. As he kills a believer intentionally with enmity, or he commits adultery while being married, or apostatizes his religion and disrupts the Community, or dares to fight God and His Prophet, and creates disturbances on earth, or like that which is inspired about the person by Sharia as a retaliation, a penalty or a punishment. The Almighty said:
• "Never should a Believer kill a Believer; except by mistake, and whoever kills a Believer by mistake, It is ordained that he should free a believing slave. And pay blood-money to the deceased's family, unless they remit it freely."
To the saying of the Almighty Allah:
• "If a man kills a Believer intentionally, his recompense is Hell, to abide therein (For ever): and the wrath, and the curse of Allah are upon him, and a dreadful chastisement is prepared for him."
And He said:
• "Nor take life-which Allah has made sacred-except for just cause. And if anyone is slain wrongfully, We have given his heir Authority (to demand Qisas or to forgive): but let him not exceed bounds in the matter of taking life; for he is helped (by the Law)."
Abu Bakr (may Allah be pleased with him) said: the Prophet (May the peace and blessings of Allah be upon him) was delivering us a sermon on a day of slaughtering, he said: 'which day is it?'

We said: 'Allah and His Messenger know greatly.' and then he became quiet till we thought that he would call it by without its name. He said: 'Is it not slaughtering day?' We said: 'yes.' He said: 'Which month is it?' We said: 'Allah and His Messenger know greatly.' And then he became quiet till we thought that he would call it by without its name. He said: 'Is that not Zil Hijjah?' [Last month of the Hijri year] We said: 'yes.' He said: 'Which land is it?' We said: 'Allah and His Messenger know greatly.' And then he became quiet till we thought that he would call it by without its name. He said: 'Is this not the Sacred Land?' We said: 'yes.' He said: 'Then, of course your blood and wealth are sacred on you like the sacredness of this day of yours, in this month of yours and at this country of yours, until the day you will meet the Lord of yours. Attention! Have you heard of?' They said: 'yes.' He said: 'My Allah, be witness! So, the present (individuals) should preach it to the absent (people), hence, many preachers are more preservers than listeners. And after me, do not turn infidels lest some of you should kill others of you.')
And it was narrated by Ibn Mas'ud that: the Prophet (May the peace and blessings of Allah be upon him) said: 'The blood of any Muslim who bears witness that there is no god but Allah, and that I am the Messenger of Allah, has been made unlawful. Excluding by one of three: the person by the person, the divorcee adulterer, the apostate from the Religion, and leaving the congregational prayer).

Since a lot of texts have been received in his honoring and the care of his sanctity after his death: In [Sunan Abu Dawood] and others: that the Prophet (May the peace and blessings of Allah be upon him) said: 'Breaking the bone of the dead is like breaking it of the alive.' And it is proved that: 'the Prophet (May the peace and blessings of Allah be upon him) prevented from sitting on graves.'
Further more, there are verses and Hadith which tell about the protection of Muslim blood and the necessity of his honoring dead or alive, even it necessarily became known of the Religion, hence enriched from any figuring out on it.
And some people are considered as Muslims as far as the protection of Muslim blood and his sanctity in total who is a confederate, whether his pledge about reconciliation, peace or pact on Jizyah (capitation). Thus his blood is not allowed, nor harming him as long as he is in the pledge. And whose humiliation, even after his death is not allowed. There is the saying of the Almighty for all:
• 'Fulfill the Covenant of Allah when ye have entered into it, and break not your oaths after ye have confirmed them; Indeed ye have made Allah your surety; for Allah knoweth all that ye do.'
And He says:
• 'And be not like a woman who breaks into untwisted strands, the yarn which she has spun after it has become strong. Using your oaths to deceive one another, lest one party should be more numerous than another: For Allah will test you by this; And on the Day of Judgment He will certainly make clear to you (the truth of) that wherein ye disagree.'
Also said:
• 'And fulfill (Every) engagement will be enquired into (On the Day of Reckoning).'
And as it is proved that the Messenger of Allah (May the peace and blessings of Allah be upon him) said: 'He who murdered a confederate person without his quintessence, Allah hath made the Paradise unlawful on him.'
And he said: 'Who killed a confederate person, he would not smell the fragrance of the Paradise. Even, indeed its fragrance to be found from distance of forty years.'

It is authenticated through the Hadith of Ali (may Allah be pleased with him) that the Prophet (May the peace and blessings of Allah be upon him) said: 'Notice! A Believer should not kill any infidel with an oath in the time of his pledge. Who created a schism, it would be on his own. He who created a schism, or lodged a causer then the curse of Allah, and of the angels and of all the people is on him.'
And whatever Abu Dawood narrated in [his Sunan] from Saleem Bin Aamir – a man from Hameer – is that there was an agreement between Mu'awiyah and Romans. And Mu'awiyah walked towards them, so that after completing the agreement time he could fight them. Then a man came on a horse or workhorse saying: 'Allah is great, Allah is great.' Loyalty not deception, they saw him and found that he was Amr Bin Absah. Mu'awiyah sent a man to him for asking the reason. Then he said: I listened to the Prophet of Allah (May the peace and blessings of Allah be upon him) saying: ' If there is an agreement between two parties, so he should not tighten the knots and would not open that until it would be completed totally. Or they would leave it equally.' Then, Mu'awiyah went back.
But Islam brought the protection of the blood of children of the combatant non-believers and their women, and prevented from disfiguring their killed people by doing justice and mercy from it on them as a whole. As it is known in Hadith of Buraidah bin al-Haseeb and in other Hadiths etc.
And in [Sunan Abu Dawood] and others: the Prophet (May the peace and blessings of Allah be upon him) said: 'Breaking the bone of the dead is like breaking it of the alive.'

ولتحويل البيانات؟
