Gostaria de saber a melhor tradução para o termo para-marcária no seguinte contexto:

"Com efeito, embora não se cuide de tutela específica da marca, mas de cessação de concorrência desleal, o trade dress, prestigiado pela constituição, pela legislação infraconstitucional interna e transnacional, tem função similar à da marca, denominada pela doutrina 'PARA-MARCÁRIAS'."

Devo traduzir este termo como 'para-branding'? Não encontrei nada a esse respeito.
Desde já agradeço-lhes a valiosíssima ajuda!!

Para-marcária Aqui não se trata de brand mas de "trade mark". Assim o trade dress (get-up, look and feel) de um produto, é típicamente a embalagem e rotulagem do produto, e tem proteção análoga à das marcas desde que é distintivo e não-funcional.

I'll leave Mark R. to post his 'trade dress' translation as an answer, though its intro or insinuation into UK vs. US IP / Intellectual Property law seems to have happened way after 'my time'.

Brand extensions -> compare the narrower tort of ('parasitic') passing-off & parafiscal > 'tax-related'.
