As far as diplomatic language is concerned, it is a Mudhakarra. You can call it مذكرة تعاون because of the context, but it is not the agreement itself - note: "purpose of an MOA is to have a written understanding of the agreement between parties", which means that it actually EXPLAINS the agreement.
