English term

waiver of Obligations

English to French Law/Patents Marketing
"The waiver by either Party of a breach or other violation of any provision of this Agreement shall not operate as, or be construed to be, a waiver of any subsequent breach of the same or others provision of this agreement."

Discussion

Germaine Apr 1, 2017:

@ Asker I suspect you may be looking at this the wrong way round, as this is not really a 'renoncement' (?).
In plain EN, it means if you let the other party get away with doing soemthing wrong once, it doesn't mean you have given them carte blanche to do the same thing again, nor that the condition requiring them not to do it is annulled, nor any others with it.

In terms of a law, this sort of waiver' is a 'dérogation', here it has perhaps more the sense of a 'dispense' — except that the text is talking about 'tolerating a breach / violation' and so it is being expressed in a slightly different way.

here "waiver of obligations" means

not literally

"renonciation aux obligations"

IOW "tolérance des violations de contrat" for a shorter version

a sample of "tolérance" in a legal context:

"waiving" doesn't imply explicitly / actively allowing the other party to ignore some of its obligations, it's more a passive response (or lack of it, more precisely) - failing to react, so "tolérance" sounds appropriate.
