Para la legislación aduanera es claro que un importador al tener el carácter de permanente u ocasional, deberá utilizar un declarante autorizado para que a nombre de él y por un contrato de mandato realice las operaciones pertinentes a la nacionalización de la mercancía y, sobre todo, el pago de los tributos de la misma. De otra parte, en lo tocante a la retención en la fuente en los contratos de mandatos, la entidad administrativa se remitió a lo dispuesto por el artículo 1.2.4.11 del Decreto 1625 de 2016:
