I would like to confirm the use of this term in this context. "deriving' just does not seem right.
The context is:
La dite caution sera saisie en cas de refus de signature du marché découlant de cet appel d'offre national et international restreint, par un soumissionnaire ou de son retrait durant la periode de validité des offres.

I'm not sure why, but "ensuing from" seems a little awkward here. It is often an acceptable translation, but, as always, context is everything.
I am going to go with "arising out of", which is standard legalese and sounds like natural English in this context.
