XXXXXXXXXXX.-------------- En General Pico, Departamento Maracó, Provincia de La Pampa, a los catorce días del mes de junio de dos mil ocho, ante mí, XXXX XXX, Notaria Titular del Registro número XXXXX de este localidad y testigos que se expresarán, COMPARECE: XXXXXXX, argentino, nacido el XX de febrero de 1945, casado en primeras nupcias con XXXXX XXX, hijo de XXXXX XXX y de XXXXXXX, titular de la Libreta de Enrolamiento número XXXXXX y domiciliado en XXXX XXX, de la localidad de General Pico, Provincia de La Pampa, capaz y de mi conocimiento, doy fe, quien encontrándose a mi juicio y de los expresados testigos en pleno uso y goce de sus facultades mentales, expone: que ha resuelto otorgar testamento por acto público, disponiendo de sus bienes para después de su muerte, a cuyo efecto dictó con toda claridad sus disposiciones, las que hago constar en el orden siguiente:
Que por este acto constituye FIDEICOMISO DE ADMINISTRACIÓN e INVERSIÓN del producido de su seguro de vida de acuerdo a las siguientes cláusulas y condiciones: I.- El XX de abril de 199X contrató un seguro de vida con la compañía XXXXXXXXXXX S.A., bajo el número de póliza XXX, por la suma de cincuenta mil dólares estadounidenses billetes, manteniendo la vigencia de la misma y todos los pagos al día. II.- En la mencionada póliza ha designado para su cobro al tiempo de su fallecimiento y en el carácter de fiduciario a su cónyuge XXXXXX XXX.
IV.- El fiduciario tendrá la facultad de ejercer todos los derechos y acciones que le corresponden para el cobro y conservación de la suma dineraria que recibirá incluyendo la de elegir cualquiera de las opciones de liquidación.

In the city of General Pico, District of Maracó, Province of La Pampa, on the fourteenth day of the month of June of the year two thousand and eight, before me, XXXXXXXXX, Chief Notary of Registry number XXXXX of this city, and the witnesses who shall be mentioned hereinbelow, THERE APPEARS XXXXX XXX, Argentinian, born on February XXth, 1945, capable, married in first wedlock to XXXXX XXX; the son of XXXX XXX and XXXX XXX, respectively, holder of the identity card no. XXX, domiciled at XXXXXX XXX, in the city of General Pico, Province of La Pampa, who, to the best of my knowledge and to the best of the witnesses’ knowledge, is of sound mind and disposing memory. By virtue of this act, he makes, publishes, and declares this instrument to be his will trust under a deed and clearly states the distribution of his possessions as follows:
He hereby creates an ADMINISTRATIVE AND INVESTMENT TRUST over his life insurance policy under the following terms and conditions: I. On April 4th, 1995, he hired a trust policy registered under the number XXX, for the amount of fifty thousand American dollars from the company XXXXXXXXXXS.A. and declared that such policy is in full force and effect and all payments are up-to-date. II. In the aforementioned policy, he nominates, appoints and constitutes his spouse, XXXXXXXXX, as trustee and beneficiary thereof upon his death.
IV. The trustee shall perform in full capacity all the rights and actions for the collection, payment and conservation of the monetary amount to be received, including the right to choose any of the liquidation options.
