Naturalmente dependerá de la jurisdicción en cuestión, pero en España este tipo de acuerdo (bargain) para rebajar la condena a cambio de aceptar la culpabilidad y facilitar en general todo el proceso judicial se llama un pacto con la Fiscalía.

The way I usually hear it is to “enter a plea”, not “enter a plea bargain”. It is the answer that is being entered into the record by the defendant, or counsel, which is usually preceeded by the parties having informed the court what the plea bargain is. In other words, the court must know what the plea bargain is before accepting it and the defendant’s plea.

En español, diría “hacer constancia de la contestación”. O sea, se hace constancia para fines del registro (record). Si por si acaso realmente es la frase “plea bargain” la que hay que traducir, diría “haga constancia de su conformidad” o “haga constancia de la conformidad entre las partes”.

“Hacer constar”, sí. “Hacer constancia de algo”, no. Con el verbo, coloca “hacer”; con el sustantivo, “dejar”.

“dejar constancia de la contestación”
“hacer constar la contestación”

“deje constancia de la conformidad entre las partes”
“haga constar la conformidad entre las partes”
