En todo caso el crédito debe ser cierto y exigible para que la retención se lleve a cabo. A partir de ese momento, la no devolución de la cosa tiene una función coactiva sobre el obligado, pues sólo cuando cumpla, podrá recuperar su posesión, y una función conservadora, ya que evita que la cosa se destruya o desaparezca en manos del deudor. En última instancia es un reflejo del principio de responsabilidad patrimonial universal del artículo 1911, según el cual el deudor responde de sus deudas con todos sus bienes presentes y futuros.
Has this got something to do with floating charge perhaps??

that's just a guess at the translation, but stay away from floating charge. The concept for your term is explained in the second part of the sentence - all the debtor's present and future assets can be attached to cover his liabilities
