German term

Motive zum BGB

German to English Law/Patents Law (general)
Eg. "Diese Sicht entspricht den Motiven zum BGB, in denen die Hingabe eines Wechsels als Beispiel für die Eingehung einer Verbindlichkeit genannt ist....."

Does "Motiven" refer to a commentary on a statutory provision?

Thanks.

Monika Elisabeth Sieger Aug 12, 2009:
Motif or motive (as you like it) is just the right expression for it. This is used in a Translation of the BGB by NOMOS itself!
Kerstin Green Aug 1, 2009:
This refers to a publication... ... called "Motive zu dem Entwurfe eines bürgerlichen Gesetzbuches für das Deutsche Reich". It seems to also be included in another book "Die gesammten Materialien zum Bürgerlichen Gesetzbuch für das Deutsche Reich" by Benno Mugdan. I have not found the proper translation yet, but maybe this helps to put you on the right track.

Motives / Commentary to the German Civil Code

I am not sure of this, but if you google around a little you will find that 'Motives' is used in a lot af (academic) English texts.
Alternatively it could be 'Commentary to the German Civil Code'
Again, not really sure as I'm not too much into that part of law.

Example sentence:

It was published in 1888, together with five vast volumes of “motives,” giving the why and wherefore for all that was proposed.

2 KudoZ points awarded for this answer. Comment: "Many thanks. "Motives" is not an accurate rendition into academic English, but I was mainly after confirmation that it was a commentary. I think the best thing is to leave it in German, as I am sure a German would do when confronted with a similar reference to a British commentary. CIAO"
