Fatherhood does bring a lot of challenges when going through a family law event. However, that does not mean that Father's have no rights during a family law event.

It is prudent to have a diversified asset class in an SMSF so that the fund is not exposed to vagaries of a single asset class. It is even more so when a family law event occurs. If there is a single asset, then solving the family law situation may mean sale with CGT consequences and other transaction costs. Alternatively, it may mean having a separated/divorced spouse as a new member, giving rise to all the trusteeship problems outlined above.
