Natomiast w niniejszej sprawie wobec braku jakiejkolwiek dokumentacji świadczącej o fakcie podjęcia zatrudnienia w 1970 roku, nie sposób jedynie na podstawie zeznań świadka A. P. i zeznań wnioskodawcy, złożonych w charakterze strony, ustalić istnienia stosunku pracy w okresie od dnia 20 czerwca do dnia 31 sierpnia 1970 roku. Równie dobrze wnioskodawca mógł świadczyć pracę, ale nie w reżimie pracowniczym, a nadto mógł też świadczyć pracę w wymiarze mniejszym niż 4 godziny dziennie.

Stąd jeśli E. Ł. (1) wykonywała obowiązki na rzecz M. F., to nie czyniła tego w reżimie pracowniczym, a w ramach umowy cywilnej (np. zlecenia), w której nie obowiązują w/w zasady.
