Returning to the topic of processing of personal data under the privacy code:

"...il contratto prevede la titolarità (oppure contitolarità) del trattamento dei dati..."

How would you interpret this titolarità? Is it actually a type of ownership or more like responsibility?

I would translate as responsibility for processing the data. The Data Controller is the person responsible for the processing of personal data.

Woops, yep it is Angela thanks. :-( I was just looking at the terms and something with both the Italian and English. I’ll check out another source.

It does mean ownership but in this case I think that this really means the responsability for the processing of data (personal data and data not to be disclosed to third parties) by the company. In other words that details will not be disclosed to third parties. Its just as simple as that. Have a merry xmas! Please see below!

**DATA CONTROLLER**
For the purposes of this code, a Data Controller means any natural or legal person who determines and controls (jointly or in common with other natural or legal persons) the purposes and the ways in which processing of Personal Data is, or is to be undertaken.

Note

A Data Controller must not be confused with a data owner. For example, an organisation can be the data owner of a database (because that natural or legal person is in possession of the material rights to use the database) and at the same time the Data Controller of the processing.
