Source text - English More than any case in the history of the Court, this proceeding presents a titanic tension between State practice and legal principle. It is accordingly the more important not to confuse the international law we have with the international law we need. In the main, the Court's Opinion meets that test. I am in essential though not entire agreement with much of it, and shall, in this opinion, set out my differences. Since however I profoundly disagree with the Court's principal and ultimate holding, I regret to be obliged to dissent.
The essence of the problem is this. Fifty years of the practice of States does not debar, and to that extent supports, the legality of the threat or use of nuclear weapons in certain circumstances. At the same time, principles of international humanitarian law which antedate that practice govern the use of all weapons including nuclear weapons, and it is extraordinarily difficult to reconcile the use - at any rate, some uses - of nuclear weapons with the application of those principles.
One way of surmounting the antinomy between practice and principle would be to put aside practice. That is what those who maintain that the threat or use of nuclear weapons is unlawful in all circumstances do. Another way is to put aside principle, to maintain that the principles of international humanitarian law do not govern nuclear weapons. That has not been done by States, including the nuclear-weapon States, in these proceedings nor should it be done. These principles - essentially proportionality in the degree of force applied, discrimination in the application of force as between combatants and civilians, and avoidance of unnecessary suffering of combatants - evolved in the pre-nuclear age. They do not easily fit the use of weaponry having the characteristics of nuclear weapons. At the same time, it is the fact that the nuclear Powers and their allies have successfully resisted applying further progressive development of humanitarian law to nuclear weapons; the record of the conferences that concluded the Geneva Conventions of 1949 and its Additional Protocols of 1977 establishes that. Nevertheless to hold that inventions in weaponry that post-date the formation of such fundamental principles are not governed by those principles would vitiate international humanitarian law. Nor is it believable that in fashioning these principles the international community meant to exclude their application to postinvented weaponry. The Martens Clause implies the contrary.
Before considering the extent to which the chasm between practice and principle may be bridged - and is bridged by the Court's Opinion - observations on their content are in order.

در طول تاریخ حقوق این جریان دعوی بیش از هر موردی تنشی عظیم میان رویه کشور و اصل حقوقی به وجود آورد. همچنین اهمیت بیشترش در این است که حقوق بین المللی که داریم را با آنچه که نیاز داریم اشتباه نگیریم. به طور کلی نظرات دیوان متناسب با این آزمون بودند. اینجانب با بخشهای مهمی از آن و نه تمام قسمتها موافقت دارم و بنابراین به شرح تفاوت دیدگاهها خواهم پرداخت. از آنجا که بنده عمیقاً با ذینفع بودن دیوان و هرگونه سهامداری آن مخالفم، متأسفانه مجبور به مخالفت می باشم.
اصل این مشکل اینگونه است. پنجاه سال رویه کشورها از مشروعیت تهدید یا کاربرد سلاحهای هسته ای در شرایط خاص جلوگیری نکرده و تا حدی حمایت نیز می کند. در عین حال اصول حقوق انسانی بین المللی که مقدم بر این رویه می باشد کاربرد کلیة سلاحها از جمله سلاحهای اتمی را تعیین می کند و سازگار کردن این کاربرد سلاحهای اتمی – به هر اندازه و شکلی - با اجرای آن اصول بسیار غامض می باشد.
یکی از راههای غلبه بر تناقض موجود میان رویه و اصول این است که رویه را کنار بگذاریم. این کاری است که افرادی انجام می دهند که اعتقاد به غیرقانونی بودن تهدید یا کاربرد سلاحهای هسته ای تحت هر شرایطی دارند. راه دیگر این است که اصول را کنار بگذاریم و به این اعتقاد داشته باشیم که اصول قوانین انسانی بین المللی تسلطی بر سلاحهای اتمی ندارند. این کار توسط کشورها، شامل کشورهای دارای سلاح هسته ای، در این دعوی انجام نشده و نباید هم بشود. این اصول – که مهمترینشان عبارتند از رعایت تناسب در به کارگیری میزان نیروی به کار رفته، تفاوت در به کارگیری نیروها در مواجهه با نیروهای نظامی و افراد غیرنظامی و اجتناب از آسیبهای غیرضروری به طرفهای درگیر – در دوران قبل از قدرت هسته ای شکل گرفته اند و به راحتی در مورد کاربرد سلاحهایی با ویژگیهای سلاحهای هسته ای جوابگو نیستند. در همین حال این واقعیت مطرح است که قدرتهای هسته ای و همفکرانشان در برابر افزودن پیشرفتهای جدید حقوق انسانی به سلاحهای هسته ای با موفقیت مقاومت کرده اند؛ گزارشهای کنفرانسهای منتج به کنوانسیون ژنو در1949 و پروتکلهای الحاقی آن در1977 مؤید این مطلب است. با این وجود دانستن اینکه این ابداعات در ساخت سلاح که پس از شکل گیری این اصول اساسی به وجود آمده اند تحت کنترل آن اصول نیستند باعث تضعیف قوانین انسانی بین المللی می شود. همچنین نمی توان باور کرد که با طراحی این اصول، جامعة بین المللی می خواسته تا کاربردشان را برای سلاحهایی که پس از آن ابداع می شوند استثناء کند. قید مارتنز گویای عکس این است.
قبل از پرداختن به میزان رفع احتمالی شکاف میان رویه و اصول – که این اتفاق در نظرات دیوان واقعاً هم افتاده است – ملاحظاتی دربارة محتوای آنها لازم به نظر می رسد.

در هنگام برگزاری نخستین کنگره جهانی امام رضا علیه السلام در مشهد مقدس توسط دانشگاه اسلامی رضوی ،مقام معظم رهبری در پیامی جامع یکی از فصلهای عمده زندگینامه سیاسی امام رضا علیه السلام را مورد بررسی قرار دادند.

تشکیل کنگره علمی زندگی امام هشتم(ع) در جوار تربت پاک آن بزرگوار و همزمان با سالروز ولادت آن حضرت، گام تازهای در جهت روشنگری چهره تابناک ائمه معصومین علیهم السلام و آشنایی با زندگینامه پرحماسه و پر رنج آن پیشوایان عظیم الشان است. باید اعتراف کنیم که زندگی ائمه علیهم السلام بدرستی شناخته نشده و ارج و منزلت جهاد مرارت بار آنان حتی بر شیعیانشان نیز پوشیده مانده است.
علیرغم هزاران کتاب کوچک و بزرگ و قدیم و جدید درباره زندگی ائمه(ع) امروز همچنان غباری از ابهام و اجمال بخش عظیمی از زندگی این بزرگواران را فراگرفته و حیات سیاسی برجسته ترین چهره های خاندان نبوت که دو قرن و نیم از حساسترین دوران های تاریخ اسلام را در بر میگیرد با غرض ورزی یا بی اعتنایی و یا کج فهمی بسیاری از پژوهندگان و نویسندگان روبرو شدهاست، این است که ما از یک تاریخچه مدون و مضبوط درباره زندگی پرحادثه و پر ماجرای آن پیشوایان تهیدستیم.
زندگی امام هشتم(ع) که قریب بیست سال از این دوره تعیین کننده و مهم را فرا گرفته از جمله برجسته ترین بخش های آن است که بجاست درباره آن تامل و تحقیق لازم بکار رود.
مهمترین چیزی که در زندگی ائمه(ع) بطور شایسته مورد توجه قرار نگرفته عنصر «مبارزه حاد سیاسی» است. از آغاز نیمه دوم قرن اول هجری كه خلافت اسلامی به طور آشكار با پیرایه های سلطنت آمیخته شد و امامت اسلامی به حكومت جابرانه پادشاهی بدل گشت، ائمه اهل بیت علیهم السلام، مبارزه سیاسی خود را به شیوه ای متناسب با اوضاع و شرایط، شدت بخشیدند.
این مبارزه بزرگترین هدفش تشكیل نظام اسلامی و تاسیس حكومتی بر پایه امامت بود. بی شك تبیین و تفسیر دین با دیدگاه مخصوص اهل بیت وحی، و رفع تحریف ها و كج فهمی ها از معارف اسلامی و احكام دینی نیز هدف مهمی برای جهاد اهل بیت به حساب می آمد. اما طبق قرائن حتمی، جهاد اهل بیت به این هدفها محدود نمی شد و بزرگترین هدف آن، چیزی جز تشكیل حكومت علوی و تاسیس نظام عادلانه اسلامی نبود. بیشترین دشواریهای زندگی مرارت بار و پر از ایثار ائمه و یاران آنان به خاطر داشتن این هدف بود و ائمه علیهم السلام، از دوران امام سجاد علیه السلام، و بعد ازحادثه عاشورا به زمینه سازی دراز مدت برای این مقصود پرداختند.
در تمام دوران صدو چهل ساله میان حادثه عاشورا و ولایتعهدی امام هشتم علیه السلام، جریان وابسته به امامان اهل بیت یعنی شیعیان همیشه بزرگترین و خطرناكترین دشمن دستگاههای خلافت به حساب می آمد. در این مدت بارها زمینه های آماده ای پیش آمد و مبارزات تشیع كه باید آن را نهضت علوی نام داد به پیروزیهای بزرگی نزدیك گردید.
اما، در هر بار موانعی برسر راه پیروزی نهایی پدید می آمد و غالبا بزرگترین ضربه از ناحیه تهاجم بر محور و مركز اصلی این نهضت، یعنی شخص امام در هر زمان و به زندان افكندن یا به شهادت رساندن آن حضرت وارد می گشت و هنگامی كه نوبت به امام بعد می رسید اختناق و فشار و سختگیری به حدی بود كه برای آماده كردن زمینه به زمان طولانی دیگری نیاز بود.
Translation - English Imam Reza, the Great Guider of Shi'a in the Turbulent Marv (Khorasan)
Note: At the time of holding the first International Congress on Imam Reza by the Razavi Islamic University in Mashhad, the Supreme Leader described one of the most important political periods in the life of that Imam through sending a message to this Congress. Here is that message:
In the Name of Allah, the Beneficent the Merciful
Arranging a scientific congress on the life of Imam Reza in Mashhad where His holy shrine is located and at the time of His birth anniversary is a new step in the way of shedding light on the lives of our infallible Imams so people may get better acquaintance with Their perfect and painful lives. This is a bitter truth that Their lives have not been studied and scrutinized even by the Shi'a Muslims let alone other people.
Despite thousands of different books available on the lives of Imams from early times up to now, obscurity and brevity are at work considering the most important parts of Their lives. This problem is more serious about Their political lives which form about 250 years of one of the most significant periods of Islamic history, but has been ignored due to the researchers and authors' spite, indifference or misunderstanding. These together cause us not to have a detailed record of Their lives being compiled and available.
The life of Imam Reza (the eighth Imam) constitutes about 20 years of this important period and is of such significance that proper researches and investigations must be done about it.
The most important point in Imams' lives which has been mostly ignored is “the intense political campaign”. In the second half of the first century A.H. (Anno Hegirae) when the Islamic caliphate and Imamate was nearly replaced by imperial tyranny, our Imams intensified their political campaign according to the new situation.
The main goal of this campaign was establishing an Islamic government based on Imamate. Although interpreting Islam according to the viewpoints of the Prophet's Household and removing distortions and misunderstandings from the religion was also a significant goal for Their struggles but based on undeniable proofs the ultimate reason for this campaign was the establishment of a heavenly and just Islamic government. Most of the difficulties and pains in Their lives are results of having such a goal; a purpose They have prepared the conditions for since Imam Sajjad (the fourth Imam) and after the Ashura disaster in 61 A.H.
From Ashura up to when Imam Reza became the successor of Ma'mun is a 140-year period during which the followers of Imams (namely Shi'as) were always the most dangerous enemies of caliphs and their fellowship. Throughout this period Shi'a campaign, which can be called the Alavid (pertaining to Imam Ali, the first Imam), could have won great victories.
But there were obstacles in the way of final victory and mostly the greatest strike was made against the axis of this movement who was the Imam Himself. Martyring or imprisoning Imam was adopted as a solution by caliphs in different eras, and after doing such, they made political limitations and pressures so that it took a long time for the next Imam to prepare the necessary conditions for gaining Their goal.
